A RESOLUTION DECLARING THE INTENTION OF THE BOARD OF COMMISSIONERS OF SALT LAKE CITY,,;SALT LAKE COUNTY, STATE OF UTAH, TO CONSTRUCT A SANITARY SEWER LINE CONSISTING OF APPROXIMATELY 2,424.00 FEET OF 8-INCH AND 2,985.00 FEET OF 12-INCH SEWER PIPE INCLUDING WYES, MANHOLES, AND FLUSH TANKS; TO CREATE A SPECIAL SEWER EXTENSION DISTRICT NO. 50-923 IN SAID CITY; TO DEFRAY THE COST AND EXPENSES OF SAID IMPROVEMENTS BY SPECIAL ASSESSMENT TO BE LEVIED AGAINST THE PROPERTY BENEFITED BY SUCH IMPROVEMENTS: PROVIDING FOR A NOTICE OF INTENTION TO AUTHORIZE SUCH SEWER EXTENSION DISTRICT AND FIXING A TIME AND PLACE FOR PROTESTS AGAINST SUCH IMPROVEMENTS OR THE CREATION OF SUCH SEWER EXTENSION SPECIAL IMPROVEMENT DISTRICT. BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF SALT LAKE CITY, SALT LAKE COUNTY, STATE OF UTAH: SECTION 1. The Board of Commissioners of Salt Lake City, Salt Lake County, Utah, has determined and hereby determines that it will be in the best interest of said City to construct a sanitary sewer line, as specified on the plans, specifications and profiles on file in the office of the City Engineer, the said streets to be improved and the boundaries of said Sewer Extenion No. 923, all more particularly des- cribed in the Notice of Intention to construct the proposed improvements hereinafter set forth: SECTION 2. The proposed district shall be known as SANITARY SEWER EXTENSION NO. 923, of Salt Lake City, Salt Lake County, Utah: SECTION 3. The City shall pay the cost and expenses of improvements to be constructed on streets and avenues on property owned by said city. Such part of the cost and expenses of the proposed improvements as is not paid by the City shall be assessed against the lots and lands adjoin- ing, abutting, contiguous or adjacent to the proposed improvements. -2- 'SECTION 4. Written protests against the proposed improvements" or against the creation of said district must be presented and filed in the office of the City Recorder on or before the 12th day of July 5:00 13th 1967, at the hour of o'clock p.m., and on the day of July , 1967, at the hour of 10:30 o'clock a.m., at the City Hall of said city such protests shall be heard and considered by the Board of Commissioners. The City Recorder is hereby directed to give notice of intention to make the proposed improvements and of the time within which protests against the proposed improvements or the creation of said district may be filed and the date when such protests will be heard and considered, by publication in a newspaper having general circulation in Salt Lake City, said notice to be published at least four times, once during each week for four successive weeks, the last publication to be at least five days but not more than twenty days prior to the time designated in such notice within which protests must be filed, and by mailing said notice by United States mail, postage prepaid, to each owner of land to be assessed within the proposed special improvement district, at the last known address of such owner, using for such purpose the names and addresses appearing on the last completed real property assessment rolls of Salt Lake County and, in addition, by so mailing a copy of said notice addressed to "Owner" at the street number of each piece of improved property to be affected by the assess- ment. Said notices shall be mailed not later than ten days after the first publication of such notice. The City Recorder shall have on file in his office a copy of the Notice of Intention for the examination of any interested parties. Said notice shall be in the following form, to-wit: NOTICE Notice is hereby given by the Board of Commissioners of Salt Lake City, Utah, of the intention of such Board of Commissioners to make the following described improvements, to wit: To construct a sanitary sewer line consisting of approximately 2,424.00 feet of 8-inch and 2,985.00 feet of 12-inch sewer pipe, including wyes, manholes, and flush tanks, all complete according to plans, profiles and specifications on file in the office of the city engineer and defray the abutters' portion of the cost and expense thereof by special assessment upon the lots and pieces of ground to be affected or benefited by such improvements, to be assessed according to front feet situated as follows: Area: Lots 75 to 157 inclusive Third Burlington Addition; Blocks 2 to 5 inclusive in Evans Addition to Popular Grove, the east side of Redwood Road from 5th South Street to a point 252.75 feet north of 8th South Street. All of the above described area is in Sections 3 and 10, Township 1 South, Range 1 West, Salt Lake Base and Meridian. Boundaries: North - 5th South Street South - 9th South Street East - Montgomery Street West - Redwood Road Streets: Redwood Road: East side from 5th South to 9th South Streets. 9th South Street: Both sides from Montgomery Street Redwood Road. Indiana Avenue: Both sides from Montgomery Street to Redwood Road. 8th South Street: Both sides from Montgomery Street to Redwood Road. Prospect Street: Both sides from 8th South to 252.75 feet north of 8th South Street. IMPROVEMENTS AND ESTIMATED COSTS Proposed Front Feet of Estimated Cost Total Improvements Abutting Property Per Front Foot Estimated Cost 8-inch and 12-inch Sanitary Sewer line including Wyes, Man- holes, Flush Tanks, etc. 6,503.27 $ 12.78 $ 83,140.20 • -2- Abutters' cost and expenses for said improvement shall be defrayed by special tax or assessment to be paid in five (5) equal annual installments, plus five percent (5%) interest on the unpaid balance levied according to the front or linear feet of frontage upon and against all lots, pieces or parcels of land to be benefited and affected by said improvements. The whole amount of the tax may be paid without interest within a period of fifteen (15) days after notice to the taxpayer by the Salt Lake City Treasurer of the amount due. Where exemptions are to be made for corner lots, the exemptions shall be as defined and provided for in the Salt Lake City ordinance. All protests and objections to such improvements or to the carry- ing out of such intention must be in writing, signed by the owners of the property affected or benefited, describing the same, together with the number of front feet and be filed with the city recorder on or before the 12th day of July , 1967. The Board of Commissioners at its first regular meeting thereafter, to wit: the lath _ day of �' , 1967, will consider the proposed levy, and hear and consider such protests and objections to said improvements as shall have been made.
