RESOLUTION
Result
SHiRLAL., pursuant to the provisions of an ordinance t,assed
by the board of CommissioncTs of La:_t Lake City, Utah, on bay 2C,
19a7, there was created a lioard of 1-djustment to carry out the provi-
sions of Chapter 119, aession Laws of Utah, 1925, relating to zoning;
and
HERI.LS, said Board of Ajustment has the power and authority
unde: said orainance to make rules and regulations, not in conflict
with law, to govern its proceedings; and
said Board of .i.djustment has the power to and bas
granted variances from the ttTms of the zoning ordinances and has
under its rules the power to rceuire waivers from adjoining and adja-
cent property owners as a condition precedent to the granting of said
waivers; and
ELEIES, complaints may be made by subsequent -..:urchasers
of said adjacent and adjoining properties, that said purchasers hdd
no notice of the granting of said waivers or of the variances per-
mitted by the moard of idjustment; and
'AigR;11S, it is to the best interests of the public and all
concerned that notice of the existence of said waivers and the grant-
ing of said variances be available to the public.
THEE7FORE, B IT FISoLVID that the Board of Commission-
ers of Salt Lake City respectfully r-questa the board of Ldjustment
to pass a rule or regulation providing that when the board of zdjust-
ment requires a waiver from any adjoining or adjacent property owner
as a condition of granting a variance to the terms of the zoning ordi-
nance, such waiver shall be acknowledged before a notary and be in
such form as to entitle it to be recorded in the office of the County
Recorder.
BL IT FURTHDR R.L.SULVLD that the Board of Adjustment
require the petitioner requesting the vaxiance at his excense to
cause to be recorded said waivers in the office of th4 County
Recorder.
This resolution shall take effect upon its adoption.
Adopted by the Board of Commissioners of halt Lake City,
Uteh, this _4,1 dey of jy1 1932.Mayor.
