RESOLUTION.
WHEREAS, By resolution heretofore, to-wit , on the 15th day of
January, 1912 , passed by the Board of Commissioners of Salt Lake
City, P. J. Moran was directed to vacate the premises belonging to
: the city at the entrance to City Creek Canyon, and the Legal Depari-
!ment was at the same time instructed to bring proper legal prooee44
Kings to bring about the vacation of said premises; and
AREAS, On or about the ,� day of January, 1912 , said
J. Moran tendered to the Superintendent of the Waterworks Depart-
pent of Salt Lake City his check for 300.00, purporting to he in
payment of the rent of said premises for the year 1912 ; and
WHEREAS, The said Superintendent of the Waterworks Department
is without authority to accept the said check, or give a receipt
therefor, or bind the city thereby; and
WHEREAS, The city and the Board of Commissioners do not desire!
to accept said offer of said check or to accept or receive any sum
from said P. J. Moran as payment of rent of said premises for any '
period of time except for the month of January, 1912:

NOW THEREFORE, Be it resolved by the Board of Commissioners
;of Salt Lake City, Utah:
That the said three hundred dollar check of said P. J. Moran
be nit accepted by the eity, and that the same be returned to said
I.P . J. Moran.
