WHEREAS, the Board of Commissioners of Salt Lake City, Utab, did, on December 9, 1913, pass an ordinance requiring the Oregon Short Line Railroad Company to build a viaduct across its tracks on Third North Street between the west side of Fourth West Street and the west side of Third West Street in Salt Lake City, Utah; and WH REAS, the Board of Commissioners of Salt Lake City, on November 9, 1914, passed a resolution requiring said Oregon Short Line Railroad Company to widen and enlarge the present viaduct across its tracks on North Temple Street, and directing that an ordinance be drawn in accordance therewith; and WHEREAS, the said construction of said viaduct across Third North Street will enatil great expense upon said Railroad Company; and WHEREAS, financial conditions are at this time very much depressed, and it would be a severe burden upon said Railroad Company to require it to make both said improvements at the same time; and WHEREAS, the Oregon Short Line Railroad Company has agreed to widen the viaduct across its tracks at North Temple Street according to plans and specifications hereafter to be approved by the Board of Commissioners, and an ordinance hereafter to be pass- ed by the Board of Commissioners, upon condition that the ordinance passed by the Board of Commissioners on December 9, 1913, requiring the construction of the viaduct by the Oregon Short Line Railroad Company across its tracks on Third North Street between the west side of Fourth ''Jest Street and the west side of Third West Street, be repealed: NOW THEREFORE, BE IT RESOLVED that the ordinance above mentioned, passed December 9, 1913, be repealed,and that an ordin- ance to that effect be prepared by the City Attorney. BE IT FURTHER RESOLVED that the ordinance repealing the ordinance above mentioned, shall not be prepared or submitted to this Board by the City Attorney until said Oregon Short Line Rail- road Company shall have complied with an ordinance to be passed by the Board of Commissioners for the widening of the viaduct across its track on North Temple Street,in regard to presenting plans a.,d specifications and beginning the work of widening said viaduct.
