Your Petitioners, Salt Lake oily, a municipal corpora-
tion of the otete of Utah, and Mount Olivet Cemetery Assooiation,
• a corporation not for profit, herewith Petition your Honorable
bodies through. the duly elected representatives therein of the
State of Utah, for tope enactment of legislation by the Congress
• which will permit Mount Olivet Cemetery Association to convey to
Salt Lede city for public and municipal purposes 2.13 acres of
land situated in a grant of 50 acres of land made to Mount Olivet
Cemetery Association by Luke E. Wright, decretary of her, on
February 10, 1909, pursuant to Act of Congress approved January
23, 1909, Public Law ho. 194, entitled "An Act for the Exchange

aKm It is desired that the unrestricted fee simple title

be conveyed to Petitioner Salt Lake City inasmuch as said land •
will not be used as a cemetery for the burial of the dead as pres-
cribed in the conveyance to Mount Olivet Cemetery Association from
Luke E. Wri;ht, Secretory of War enu that the United States waive
and disclaim all right to the reversion or reverter to it of the
tract of land of 2.18 acres in case it ceases to be used for
cemetery purposes and permit the conveyance of it in tee simple
free from such reverter.
It is also desired that the enactment of such legisle
tion and the conveyance of the land by sale ,association to said
City provide that same shall in no way alter or affect the Associa-
tion's ownership of, or its rights and privileges with respect ,
to, the remainder of the land so granted to said Association by
said Act of Congress of January 23, 1909, and conveyed to it by
Luke E. Wright, Secretary of War on February 10, 1909.

RESOLU TI ON
WHEREAL, Mount Glivet Cemetery Association, by Act of
Congress approved January 23, L909, public law No. 194, and grant
from Luke E. Wright, Secretary of Wer dated February 10, 1909, was
granted a 50-acre tract of land in the southwest corner of the
Fort Douglas Military Reservation, to have and to hold the same
for use as a cemetery for the burial of the dean with the proviso
that when the said premises shell cease to be used for such pur-
poses they shall revert to the United States; ana
WHEREAS, Salt Lake City has applied to this Association '
and represented that a greet public need exists for a triangular
piece of ground situated in the southwest corner of the land
granted to Mount Olivet Cemetery Association by the United States
3 of America for cemetery purposes ana this Board, upon investigation,

zz ; WHEREAS, Mount Olivet Cemetery Association cannot convey

• ' out specific authority from the Government of the United States; and
WH EREAS, in the judgment of the Board of Directors of
Mount Olivet Cemetery Association the transfer of said small
tract of land to the Salt Lake City will not substantially affect
or interfere with the purpose of the Grant of said larger tract
by the United States to it, will not disturb the operation of
Mount Olivet Cemetery Association and, at the same time, will be
of great benefit to the public and citizens of Salt Lake City; '
NOW, THEREFORE, SE IT RESOLVED that the Mount Olivet
Cemetery Association, a nonprofit corporation, hereby Joins with
Salt Lake City in petitioning the Congress of the United States
to pass an Act authorizing teas Association to convey to Salt Lakg
City the fee simple title to the following described tract of
land, situate in Salt Lake City, State of Utah, viz:

Beginning at the Southwest corner of the Mt. Olivet
Cemetery Association property (said point being 100.0 ft.
north of the original southwest corner of the Fort Louglas
Military Reservation, and in the north line of Sunnyside
Avenue, Salt Lake City, Utah); running thence N. 0 deg.
0' 28" E. along, the West line of the Cemetery Property
362.67 ft.; thence southeasterly along a 689.50 ft. radius
curve to the right, tangent to which bears S. 65 deg. 07'
07" E. a distance of 280.22 ft. to a point of reverse
curve; thence along a 610.15 ft. radius curve to the left,
tangent to which bears S. 41 deg. 49'59" E., a distance of
425.91 ft. to a point in the south line of the Cemetery
Property which is the north line of bunnyelde Avenue;
thence S. 89 deg. 59' 50" W. along said line 591.58 ft.
to point of beginning, containing 2.18 acres.
Provided always, that the conveyanoe of said described tract of
land to bait Lake City shall not in any way alter or affect this
Association's ownership of or its right and privileges with res-
pect to, the remainder of said 50 acre tract of land heretofore
granted and conveyed to this Association as above set out;

Southeast corner of the Mount Olivet Cemetery rrsnt,

value to the Citizens and -Tunicipality of Salt Lake City; and
l.ount Olivet Cemetery Association is willing
to convey to Salt Lake City the title to the aforementioned pro-
perty in fee simple if the Congress of the United States will
grant it )emission so to do and its right to the use of the re-
maining land included in said grant ,:ill not be affected; and
it is not esired or intended that the action
of the Congress wi'_l in anyway alter or effect Mount Olivet Ceme-
tery ;association's ownership of, or its rights and Privileges with
respect to, the remainder of the acid tract of land so -ranted as
aforesaid by the United states to it as aJove set out.
