Fehr - - - Finch - LOte Mr.Chairman - Result SOLUTION WHEREAS, Salt Lake City has acquired certain water rights in the Little Cottonwood Creek in_,Salt Lake County, State of Utah, and has determined that for the good of the inhabitants of Salt Lake City it is necessary to bring said acquired water- by pipeline to the Big Cottonwood conduit and thence to Salt Lake City, Utah, to be distributed among its inhabitants; and WHEREAS, Salt Lake City has entered into a contract to have said pipeline laid for the purpose of bringing said water to Big Cottonwood conduit and thence to Salt Lake City; and WHEREAS, it is necessary in order to bring said water to Big Cottonwood conduit and thence to Salt Lake City that a pipeline be laid from Little Cottonwood Creek to Big Cottonwood conduit for the purpose of delivering said water to the water mains of Salt Lake City and distributing it to the inhabitants of said city; and WHEREAS, it is and is hereby declared to be necessary for said city to have a perpetual easement for a right of way over the following described property through which said pipeline will run, to—wit: Beginning 22.8 ft. west oZ' the N. W. corner of the N. E. a of the S. E. 4 of Sec. 35, . 2 8., R. 1 E., S. L. B. & M., in the north fence line of the Thomas A. Lovell property; thence S. 1° 481 W. 624.2 ft., thence S. 30° 201 E. 820 ft. plus or minus to the boundary fence between the Lowell and the Wm. H. Dyer et. al. properties. (Length 1444 ft. plus or minus.) and WHEREAS, the owners of the land over which said pipeline is to run have refused to accept the price tendered by the city fo said perpetual easement. NOW THEREFORE, BE !T' SOLVED that the City Attorney be and he hereby is instructed and directed to bring suit against the owners of the property described above for the purpose of acquiring a perpetual right of way easement to Salt Lake City by condemnatio. For the purpose of laying and constructing said, pipeline from Litt , Cottonwood Creek to Big Cottonwood conduit and thence to Salt Lake City. BE IT FURTHER RESOLVED that said City Attorney be and he hereby is instructed to commence such proceedings at once. It is necessary in the opinion of the Board of Commissio ers for the peace, health and safety of the inhabitants of Salt Lake City,.Utah, that this resolutio4•take effect upon its passage.
