WHEREAS, the Utah Light & Traction Company
now owning and operating the street oar system in Salt
Lake City and suburbs has applied to the Public Utilities
Commission of Utah for permission-to increase its charges
for transportation of passengers, and
WHEREAS the said Company is 'operating its
said system of tracks under a franchise granted by the
City of Salt Lake on or about December 30, 1909, upon the
terms and conditions and for the period of time specified
in said franchise, and
WHEREAS among the said conditions contained
in said franchise, and in consideration of the granting of
the same, the rates of fare now being charged by said
Company and paid by passengers transported by it, were fixed
by said franchise and accepted by the predecessor of the
said Company and made binding and obligatory upon the said
grantee and its successors, including the said Utah Light
& Traction Company, and
WHEREAS the said franchise constitutes a
contract between the said Company and said Salt Lake City,
extending during the term fixed therein and being fifty
years from the date of the acceptance thereof,
NOW THEREFORE, be it RESOLVED by the City
Commission of Salt Lake City. tbat it insists upon the per-
formance-by the said Company of the,conditions aforesaid
contained in said franchise with reference to the$Itee
to be charged passengers thereon, and objects to any change
being amie therein by the Public Utilities Commission as
being tabamaiataat with. and. violative of the rights of said
City and of the citizens of Salt Lake City and vicinity
ender the provisions of said franchise, and
RESOLVED further that a Dopy of the foregoing
preamble and these resolutions be presented to and filed
with the Public Utilities Commission in said matter and that
the City Attorney be and he is hereby authorized and direct-
ed to appear before the said Public Utilities Commission
and present by oral argument and explanation or otherwise
the claims of said City in this behalf.
