Scheid Shearman Wells Mr.Chairman Result RESOLUTION WHEREAS, by an ordinance duly passed by the City Council of Salt Lake City, December 9, 1907, approved by the Mayor December 10, 1907, a franchise and right of way was given and granted to the Rio Grande Western Railroad Company, its successors and assigns, to lay, construct and operate a switch or spur standard gauge railroad track leading from a convenient point on its railway line on Fourth West and about 100 feet south of the south line of First South Street in Salt Lake City,Utah, and running from thence on a curve par- tially across said Fourth West Street to a point approximately 499 feet south from the south line of said Fourth South Street, and 25 feet east of the west property line of said Fourth West Street; said spur track being opposite a portion of Lot 8, and the north 169 feet of Lot 1, in Block 64, Plat "ATM, Salt Lake City Survey; and WHEREAS, by Section 4 of said ordinance, it is provided that this franchise is granted for and during the pleasure of the City Council; and WHEREAS, the spur track aforesaid was constructed as provided for in said franchise, and said track is now at the place indicated by said franchise; and WHEREAS, it is now the pleasure of the Board of Commis- sioners of Salt Lake City that said franchise be, and the same is hereby terminated; NOW THEREFORE, BE IT RESOLVED by the Board of Commissioner, of Salt Lake City, that the franchise above mentioned be, and the same is hereby terminated, and the said Rio Grande Western Railroad Company, (now the Denver and Rio Grande Railway Company) is hereby ordered and directed to remove the tracks laid under said franchise from said Fourth West street, within ten days after receipt of certified copy of this resolution. BE IT FURTHER RESOLVED that the City Recorder be, and he is hereby directed to cause a certified copy of this resolution to be served upon said Denver and Rio Grande Railway Company.
