A RESOLUTION DECLARING THE INTENTION OF THE BOARD
OF COMMISSIONERS OF SALT LAKE CITY, SALT LAKE COUNTY,
STATE OF UTAH, TO CONSTRUCT A SANITARY SEWER LINE
CONSISTING OF APPROXIMATELY 2,913.0 LINEAL FEET OF
12-INCH AND 54.0 LINEAL FEET OF 10-INCH AND 7,474.0
LINEAL FEET OF 8-INCH SEWER PIPE INCLUDING WYES,
MANHOLES, AND FLUSH TANKS; TO CREATE A SPECIAL SEWER
EXTENSION DISTRICT NO. 944 IN SAID CITY; TO DEFRAY
THE COST AND EXPENSES OF SAID IMPROVEMENTS BY SPECIAL
ASSESSMENT TO BE LEVIED AGAINST THE PROPERTY BENEFITED
BY SUCH IMPROVEMENTS: PROVIDING FOR A NOTICE OF
INTENTION TO AUTHORIZE SUCH SEWER EXTENSION DISTRICT
AND FIXING A TIME AND PLACE FOR PROTESTS AGAINST SUCH
IMPROVEMENTS OR THE CREATION OF SUCH SEWER EXTENSION
SPECIAL IMPROVEMENT DISTRICT.
BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF SALT LAKE CITY, SALT
LAKE COUNTY, STATE OF UTAH:
SECTION 1. The Board of Commissioners of Salt Lake City, Salt Lake
County, Utah, has determined and hereby determines that it will be in the
best interest of said City to construct a sanitary sewer line, as specified
on the plans, specifications and profiles on file in the office of the City
Engineer, the said streets to be improved and the boundaries of said Sewer
Extension No. 944, all more particularly described in the Notice of Intention
to construct the proposed improvements hereinafter set forth:
SECTION 2. The proposed district shall be known as SANITARY SEWER
EXTENSION NO. 944, of Salt Lake City, Salt Lake County, Utah:
SECTION 3. The City shall pay the cost and expenses of improvements
to be constructed on streets and avenues on property owned by said city.
Such part of the cost and expenses of the proposed improvements as is not
paid by the City shall be assessed against the lots and lands adjoining,
abutting, contiguous or adjacent to the proposed improvements.

SECTION 4. Written protests against the proposed improvements or
against the creation of said district must be presented and filed in the
office of the City Recorder on or before the 28th day of August
1967, at the hour of 15:00 o'clock p.m., and on the 29th day of
August , 1967, at the hour of 10:00 o'clock a.m., at the
City Hall of said city such protests shall be heard and considered by the
Board of Commissioners. The City Recorder is hereby directed to give notice
of intention to make the proposed improvements and of the time within which
protests against the proposed improvements or the creation of said district
may be filed and the date when such protests will be heard and considered,
by publication in a newspaper having general circulation in Salt Lake City,
said notice to be published at least four times, once during each week for
four successive weeks, the last publication to be at least five days but
not more than twenty days prior to the time designated in such notice within
which protests must be filed, and by mailing said notice by United States
mail, postage prepaid, to each owner of land to be assessed within the
proposed special improvement district, at the last known address of such
owner, using for such purpose the names and addresses appearing on the last
completed real property assessment rolls of Salt Lake County and, in addition,
by so mailing a copy of said notice addressed to "Owner" at the street number
of each piece of improved property to be affected by the assessment. Said
notices shall be mailed not later than ten days after the first publication
of such notice. The City Recorder shall have on file in his office a copy
of the Notice of Intention for the examination of any interested parties.
Said notice shall be in the following form, to-wit:
NOTICE
Notice is hereby given by the Board of Commissioners of Salt Lake City,
Utah, of the intention of such Board of Commissioners to make the following
described improvements, to-wit:
To construct a sanitary sewer line consisting of approximately 2,913.0
lineal feet of 12-inch and 54.0 lineal feet of 10-inch and 7,474.0 lineal
feet of 8-inch sewer pipe, including wyes, manholes, and flush tanks, all
complete according to plans, profiles and specifications on file in the
office of the city engineer and defray the abutters' portion of the cost
and expense thereof by special assessment upon the lots and pieces of ground
to be affected or benefited by such improvements, to be assessed according
to front feet situated as follows:
Area:
Blocks 1-9 inclusive, Empire Addition, Blocks 1-5 inclusive,
Superior Addition; Blocks 1-5 inclusive and Blocks 16-18
inclusive, Folsom Addition; the north side of Duluth Avenue
between Dexter Street and Chicago Street; the north side of
15th North Street between Beck Street and Hot Springs Street,
all in Section 23, Township 1 North, Range 1 West, Salt Lake
Base and Meridian.
Boundaries:
North - 17th North Street
South - 13th North Street
East - Beck Street
West - Railroad right-cf -way
Streets:
15th North Street: Both sides from Beck Street to Hot Springs
Street.
Hot Springs Street: Both sides from 15th North Street to
Everett Avenue.
Dexter Street: Both sides from 15th North Street to
Duluth Avenue.
Duluth Avenue: Both sides from Hot Springs Street to
Chicago Street.
14th North Street: Both sides from Hot Springs Street to
Railroad right-of-way.
Everett Avenue: Both sides from Beck Street to 8th West St.
8th West Street: Both sides from Everett Avenue to Duluth
Avenue.
Chicago Street: Both sides from Duluth Avenue to 17th
North Street.

Delaware Street: Both sides from Chicago Street to
Railroad right-of-way.
16th North Street: Both sides from Beck Street to
Railroad right-of-way.
Bertella Avenue: Both sides from Chicago Street to
Railroad right-of-way.

Abutters' cost and expenses for said improvement shall be defrayed by
special tax or assessment to be paid in five (5) equal annual installments,
plus five percent (5%) interest on the unpaid balance levied according to the
front or linear feet of frontage upon and against all lots, pieces or parcels
of land to be benefited and affected by said improvements.
The whole amount of the tax may be paid without interest within a period
of fifteen (15) days after notice to the taxpayer by the Salt Lake City
Treasurer of the amount due.
Where exemptions are to be made for corner lots, the exemptions shall be
as defined and provided for in the Salt Lake City ordinance.
All protests and objections to such improvements or to the carrying out
of such intention must be in writing, signed by the owners of the property
affected or benefited, describing the same, together with the number of front
feet and be filed with the city recorder on or before the 28th day of
August , 1967. The Board of Commissioners at its first regular
meeting thereafter, to wit: the 29th day of August , 1967,
will consider the proposed levy, and hear and consider such protests and
objections to said improvements as shall have been made.

City Commissioner Conrad B. Harrison thereupon moved that the
Board of Commissioners adopt the foregoing resolution. The resolution
was thereupon put to a vote and unanimously adopted on the following
recorded vote:
