Barsnick Acting City Recorder Absent: 0 CJT Thereupon the following proceedings, among others, were cry duly had and taken: co ro CP Councilmember Mabey introduced the following resolution in writing, which was read in its entirety, and moved its adoption: RESOLUTION NO. 25 A RESOLUTION DECLARING THE INTENTION OF THE CITY COUNCIL OF SALT LAKE CITY, SALT LAKE COUNTY, STATE OF UTAH, TO CONSTRUCT IMPROVEMENTS ON CERTAIN STREETS WITHIN SAID MUNICIPALITY CONSISTING OF THE PAVING OF STREETS WITH BITUMINOUS SURFACE COURSE PLACED ON COMPACTED GRAVEL BASE; CONSTRUCTING A DRAINAGE SYSTEM, CONSTRUCTING CURB AND GUTTER AND SIDEWALK; REMOVING ALL EXISTING NONCONFORMING IMPROVEMENTS; CONSTRUCTING DRIVE APPROACHES FROM THE NEW CURB AND GUTTER TO THE STREET EDGE OF SIDEWALKS; AND ALL OTHER MISCELLANEOUS WORK NECESSARY TO COMPLETE THE IMPROVEMENTS IN A PROPER WORKMANLIKE MANNER; TO CREATE SALT LAKE CITY; UTAH CURB AND GUTTER EXTENSION NO. 684; TO DEFRAY THE COST AND EXPENSES OF SAID IMPROVEMENT DISTRICT BY SPECIAL ASSESSMENTS TO BE LEVIED AGAINST THE PROPERTY BENEFITED BY SUCH IMPROVEMENTS; AND TO PROVIDE NOTICE OF INTENTION TO AUTHORIZE SUCH IMPROVEMENTS AND TO FIX A TIME AND PLACE FOR PROTESTS AGAINST SUCH IMPROVEMENTS OR THE CREATION OF SAID DISTRICT. BE IT RESOLVED by the City Council of Salt Lake City, Salt Lake County, Utah: Section 1. The City Council of Salt Lake City, Salt Lake County, Utah hereby determines, that it will be in the best interest of said Municipality to pave streets; to construct a drainage system; to construct curb and gutter and sidewalk; to 0 remove all existing nonconforming improvements; to construct Tj CP drive approaches from the new curb and gutter to the street Cr) edge of sidewalks; and to complete the whole in a proper and '" OD CD , r workmanlike manner according to plans, profiles and specifications on file in the Office of the City Engineer of Salt Lake City, Utah. A description of the proposed special improvement district is more particularly described in the Notice of Intention to construct the proposed improvements hereinafter set forth. Section 2. The proposed district shall be known as "Salt Lake City, Utah Curb and Gutter Extension No. 684". Section 3. The cost and expenses of a portion of the proposed improvements shall be paid by a special tax to be levied against the property fronting or abutting upon or adjacent to the streets to be improved or which may be affected or specially benefited by any of such improvements, such tax to be paid in not more than ten (10) equal annual installments with interest on the unpaid balance until due and paid. An allowance shall be made for corner lots as provided by City ordinance so that such lots are not assessed at full rate on both streets. Section 4. Written protests against the proposed improvements or against the creation of said District must be presented and filed in the Office of the City Recorder on or before the 4th day of May, 1981, at the hour of 5:00 p.m. o +c Thereafter at 5:00 p.m. on Tuesday, the 5th day of May, 1981 at lV the City Council Chambers in Salt Lake City, Utah, any such Q jr protests shall be heard and considered by the Council. The e, CO -3- • NOTICE OF INTENTION PUBLIC NOTICE IS HEREBY GIVEN that on the 31st day of March, 1981, the City Council of Salt Lake City, Salt Lake County, Utah, adopted a resolution declaring its intention to create a special improvement district to be known as Salt Lake City, Utah Curb and Gutter Extension No. 684. It is the intention of the District to make improvements within said Special Improvement District and to levy special taxes as provided in Chapter 16, Title 10, Utah Code Annotated, (1953), as amended, on the real estate lying within said District for the benefit of which such taxes are to be expended in the making of such improvements. Tel:(801)535.7872 TED L.WILSON PUBLIC WORKS DIRECTOR MAYOR Dear Property Owner: We wish to inform you that Curb and Gutter District No. 38-684, which includes your street is ready for construction. This project will consist of reconstruction and repaving of the street, installation of curb and gutter, sidewalks where neces- sary, driveway approaches, and installation of storm drainage facilities. Attached in this packet is a Notice of Intention describing the project and pro- viding an estimated schedule showing the cost per front foot which property owners will be assessed. Your total assessment for the project can be estimated by multi- plying the number of front feet of your property abutting the street by the rate shown for your street, and adding to that an amount for driveway approach construction. The driveway approach is estimated to cost approximately $3.00 per square foot. The purpose of the Notice of Intention is to allow you to review the estimated costs for this project, and give you the opportunity to protest the project if you are in disagreement with it. If sufficient number of protests are received on a given street, then that street will be omitted from the project. If your street is included in the project and the construction bids received this summer agree with our project estimates, then construction should begin late this spring, with completion scheduled by the fall of 1981, or spring of 1982. The Notice of Intention describes how a Special Improvement District Project is created and operates. The following are a list of some of the more important points brought out in the Notice of Intention: 1) All non-conforming improvements such as lawns, sprinkling systems, rock gardens, driveways, curbs and gutters, walks, fences, etc., which have been built by property owners within the area to be improved must be removed by the property owner, at their expense prior to commencement of the project. This includes the parkway area which is the area between the sidewalk and curb and gutter to be constructed. All non-conforming improvements not removed by property owners will be removed by the construction contractor as part of his contract. Prior to the contractor commencing construction on this parkway area, property owners will be contacted to remove any such obstructions. Where possible the project engineer will allow existing lawn to ramain if requested by the property owners. However, in many cases lawn is required to be removed because its grade does not conform to the newly established curb and gutter grades. 2) For those parkway areas which ate removed by the contractor, the property owners will be given one of these three options. CP a. The area will be brought to finished grade using existing soil. b. A 4-inch trough will be left for placement of topsoil by the property pp comer c. The property owner can choose to have topsoil and sod furnished and placed by the contractor at the owners expense. This cost will be added to the assessment and assessed only against those properties where the property owners request in writing the furnishing and place- ment of sod and topsoil. No installation of sprinkling systems will be done under this improvement project. 3) A representative from the City Engineer's Office will be contacting property owners to sign for driveway approaches and curb cuts. The cost of drive approaches will vary according to width and amount of parking area to be covered. These costs are estimated to be approximately $3.00 per square foot. The assessment for drive- ways will be charged in addition to the assessment for sidewalk, curb and gutter, paving and miscellaneous. 4) Once the project is completed Salt Lake City intends to levy the assessments to be paid by property owners. Property owners will be given the option of paying the assessment in full without interest within fifteen (15) days after the ordinance levying the assessment becomes effective, or paying the assessment in ten (10) annual installments with interest on the unpaid balance at a rate or rates fixed by -1 the City Council. An "Informal Public Meeting" is scheduled to review this project with interested abutting property owners in accordance with the following schedule; Area 1 (Southeast Streets) April 16, 7:30 - 9:00 at CA ra GA Area 2 (Avenues) April 17, 7:30 - 9:00 at i*r 00 Area 3 (Westside) April 18, 7:30 - 9:CO at 01 Members of the Engineering Division Staff will be present at the meeting with copies of the construction drawings and plans for the project. An allowance shall be made for corner lots as provided by City ordinance so that such lots are not assessed at full rate on both streets. Section 4. The rate has been reduced by $2.13 per ft. with the increased cost being placed in the City's portion. -16- • The Abutter's estimate cost per front foot does not include the cost of driveways which will vary according to width, length, and amount of parking area to be covered. These costs are estimated to be approximately $3.00 per square foot for flare and dip type driveways and $55.00 per linear foot for pipe drive including apron and waterway. The cost of driveways will be assessed against the properties benefitted in addition to the assessment for sidewalk, curb and gutter, paving and miscellaneous. The costs shown include a total of 25% increase over estimated construction costs. Of the 25%, 10% of estimated construction costs has been included for contingencies, cost of issuance of the Bonds and interest on interim warrants. An additional 15% has been added to the estimated costs to provide for engineering, administrative and other overhead costs as allowed by statute. The estimated cost of the City's portion consists of the cost of one half of all unclassified excavation, the cost of paving of all intersections, the cost of all drainage systems, the cost of relocating water systems, and sewer systems less resetting manholes and cleanout box covers and frames, the cost of replacing any existing curb and gutter and/or sidewalk necessitated by the new improvements. ASSESSMENTS AND LEVY OF TAXES It is the intention of the City Council of Salt Lake City, Utah to levy assessments as provided by the laws of Utah on all parcels and lots of real property benefited within the District. The purpose of the assessment and levy is to pay those costs of the subject improvements which the Municipality will not assume and pay. The method of assessment shall be by lineal front foot as set forth herein. The assessments may be paid by property owners in ten (10) equal installments with interest on the unpaid balance at a rate or rates fixed by the Acting City Treasurer, or the whole or any part of the assessment may be paid without -17- interest within fifteen (15) days after the ordinance levying the assessment becomes effective. The assessments shall be levied according to the benefits to be derived by each property within the District. Other payment provisions and enforcement remedies shall be in accordance with Chapter 16 of Title 10 of Utah Code Annotated, (1953), as amended. A map of the proposed District, copies of plans, profiles and specifications of the proposed improvements and other related information are on file in the office of the City Recorder who will make such information available to all interested persons. TIME FOR FILING PROTESTS Any person who is the owner of record of property to be assessed in the district described in this Notice of Intention shall have the right to file in writing a protest against the creation of Curb and Gutter Extension No. 684 or to make any other objections relating thereto. This project will consist of reconstruction and repaving of the street, installation of curb and gutter, sidewalks where neces- sary, driveway approaches, and installation of storm drainage facilities. Attached in this packet is a Notice of Intention describing the project and pro- viding an estimated schedule showing the cost per front foot which property owners will be assessed. Your total assessment for the project can be estimated by multi- plying the number of front feet of your property abutting the street by the rate shown for your street, and adding to that an amount for driveway approach construction. The driveway approach is estimated to cost approximately $3.00 per square foot. The purpose of the Notice of Intention is to allow you to review the estimated costs for this project, and give you the opportunity to protest the project if you are in disagreement with it. If sufficient number of protests are received on a given street, then that street will be omitted from the project. If your street is included in the project and the construction bids received this summer agree with our project estimates, then construction should begin late this spring, with completion scheduled by the fall of 1981, or spring of 1982. The Notice of Intention describes how a Special Improvement District Project is created and operates. The following are a list of some of the more important points brought out in the Notice of Intention: 1) All non-conforming improvements such as lawns, sprinkling systems, rock gardens, driveways, curbs and gutters, walks, fences, etc., which have been built by property owners within the area to be improved must be removed by the property owner at their expense prior to commencement of the project. This includes the parkway area which is the area between the sidewalk and curb and gutter to be constructed. All non-conforming improvements not removed by property owners will be removed by the construction contractor as part of his contract. Prior to the contractor commencing construction on this parkway area, property owners will be contacted to remove any such obstructions. Where possible the project engineer will allow existing lawn to ramain if requested by the property owners. However, in many cases lawn is required to be removed because its grade does not conform to the newly established curb and gutter grades. 2) For those parkway areas which are removed by the contractor, the property owners will be given one of these three options. a. The area will be brought to finished grade using existing soil. b. A 4-inch trough will be left for placement of topsoil by the property owner - 2 - c. The property owner can choose to have topsoil and sod furnished and placed by the contractor at the owners expense. This cost will be added to the assessment and assessed only against those properties where the property owners request in writing the furnishing and place- ment of sod and topsoil. No installation of sprinkling systems will be .done under this improvement project. 3) A representative from the City Engineer's Office will be contacting property owners to sign for driveway approaches and curb cuts. The cost of drive approaches will vary according to width and amount of parking area to be covered. These costs are estimated to be approximately $3.00 per square foot. The assessment for drive- ways will be charged in addition to the assessment for sidewalk, curb and gutter, paving and miscellaneous. 4) Once the project is completed Salt Lake City intends to levy the assessments to be paid by property owners. Property owners will be given the option of paying the assessment in full without interest within fifteen (15) days after the ordinance levying the assessment becomes effective, or paying the assessment in ten (10) annual installments with interest on the unpaid balance at a rate or rates fixed by the City Council. An "Informal Public Meeting" is scheduled to review this project with interested abutting property owners in accordance with the following schedule; Area 1 (Southeast Streets) April 16, 7:30 - 9:00 at Area 2 (Avenues) April 17, 7:30 - 9:00 at Area 3 (Westside) April 18, 7:30 - 9:CO at Members of the Engineering Division Staff will be present at the meeting with copies of the construction drawings and plans for the project. They will be available to answer any specific questions property owners have relative to project design, curb and gutter locations, and assessments. Please note the attendance at this meeting does not take the place of written protest. Those wishing to protest must follow the procedures outlined in the Notice of Intention.
