RESOLUTIO I1
WHEREAS, Salt Lake City has heretofore widened and deepened
what is known as the Surplus Canal south some distance from where
said canal and the Jordan River connect at about Twelfth South
Street , and that in so deepening said canal the city lowered the
bottom of the same some distance below where it had been, and
that with a view of restoring the condition as it had been before
said work was done, as nearly as possible , the city has construct-
ed and erected a gate at the entrance of said canal and has pro-
vided flash boards therefor, by placing which in said gate will
I control the water flowing down said canal ; and
1 WHEREAS, Salt Lake City does not own or claim any right to
1 the water flowing down said river or said canal ; and

WHEREAS, Many persons have made inquiry as to the position of
jSalt Lake City in regard to said gate and the control thereof, and
the control or distribution of the water flowing down said river
and said canal ,
Now that all persons interested may be informed in regard to

j the matters aforesaid:

Be it resolved by the Board of Commissioners of Salt Lake
City, Utah:
That it is not the intention of said city to in any manner
• operate or attempt to operate said gate , or to in any manner dis-
tribute or attempt to distribute the water flowing down the
Jordan River or the Surplus Canal. Nor has said city since the
completion of said gate in any manner operated or attempted to
operate the same , or to distribute or attempt to distribute ' the
water flowing down said river or said canal.
