Result
WHEREAS, on the 27th day of May, 1897, in a deed of
trust entered into between Moroni Edwards of Oakland, California,
party of the first part, and Marian B. Edwards, his wife, of the
same plaee, party of the second part, and Royal Proctor of Salt
Lake City, Utah, party of the third part, there appears in para-
graph 2 thereof, subdivision 7, which reads as follows:
"If permission therefor can be obtained to set aside
and expend for the erection of a public drinking fountain
at the southeast corner of the Temple Block in Salt Lake
City, the sum of One Thousand Dollars, to be built of
Utah granite, provided the authorities of said city will
accept and approve of the same. If permission cannot be
obtained for the erection thereof at said place, then to
divide said one thousand dollars equally between said
Orphan's Home and Day School and said Pioneer Library
Association."
AND WHEREAS, a monument has been heretofore erected at
the southeast corner of the Temple Block in Salt Lake City known
as the "Savage" Monument.
NOW, THEREFORE, BE IT RESOLVED that Salt Lake City hereby
refuses its permission to erect the public drinking fountain
described in said deed of trust or to accept or approve the same;
and that a copy of this resolution be forwarded to Hurd & Hurd,
Attorneys, representing Royal Proctor, Trustee of said trust deed.

Utah, this 9--day of February, A.D.
