Result
WHEREAS, SALT LAKE CITY is the owner of certain street-
car rails, track fastenings, and other track metallic material lying
in the streets of said City; and
WHEREAS, said rails, track fastenings and other track
metallic material are vitally necessary to the prosecution of the
present war; and
WHEREAS, the City desires as a contribution to the war
effort to make said rails, track fastenings and other track metallic
material immediately available for war use.
NOW, THEREFORE, BE IT RESOLVED THAT
1. Ab Jenkins, Mayor of Salt Lake City, a municipal corpora-
tion, and Ethel Macdonald as City Recorder of Salt Lake City, are
hereby authorized on behalf of the City to execute a bill of sale
and contract transferring to the War Materials, Inc., Agent for the
Metals Reserve Company, the form of which shall be approved by the
City Attorney for Salt Lake City.
2. War Materials, Inc., Agent for Metals Reserve Company,
be and it hereby is given permission, itself or through others to
remove the said rails, track fastenings, and other track metallic
materials, and for that purpose to disturb the pavements in the
streets where said rails are located; provided that the slots f4om which
the rails are removed are re-filled with suitable paving material,
all in accordance with the specifications prepared by the city engi-
neer of Salt Lake City and the removal shall be done with minimum
interference with the movement of traffic.
3. And provided that the War Materials, Inc., shall file
with Salt Lake City a good and sufficient surety bond in the sum of
50,000.00__, conditioned that the work will be completed in accord-
ante with the specifications of the City Engineer and conditioned
that it will hold Salt Lake City harmless from any claims made
against the City by reason of any accidents, injuries, or damages
to persons or property claimed to have been suffered by reason of
the operations in removing the rails and refilling the excavations
made by the removal of the rails.) -
Passed by the Board of Commissioners of Salt Lake City,
