RESOLUTION .
WHEREAS, On October 9, 1914, the Board of Commissioners
awarded a contract to R. E. Wilson to construct the fifth South
; Street Reservoir; and
WHEREAS, By the provisions of said contract the work of
( constructing said reservoir is to be completed by July 16, 1915; eid
WHEREAS, It has been made to appear to the Board of Commiseio -
era by the City Engineer that the said contractor is not prooeedin$
;with said work in such manner, end that the force employed is not j
sufficient, to insure the completion of the work by the time afore+
said; and that the contractor hes been repeatedly advised by the
City Engineer to proceed with said work, and of the great importen e
• of doing so; and
WHEREAS, It is provided in Section 18 of the contract afore-
said that if during the existence of said contract it should
appear to the City Engineer that the force employed, or the
character or progress of the work are not such as will insure the
completion of the work in the time specified, after giving the
contractor and his surety five days notice in writing to proceed
with said work, and upon the failure of the contractor to comply
with said notice the Board of Commissioners mat declare the con-
tract abandoned; and
WHEREAS, The Guardian Casualty and Guaranty Company is the
surety upon the bond of the above mentioned contractor for the
! performance of the work aforesaid;
NO THEREFORE, Be it resolved that the said R. E. Wilson,
Contractor, and the Guardian Casualty end Guaranty Company his
surety, are each hereby notified to within five days after the
' receipt of a copy of this resolution, proceed with the constructio``
• of the Fifth South Street Reservoir, and to increase the force of
men on said work so that said work shall be finished within the
time specified in said contract.

BE IT FURTHER RESOLVED, That a certified copy of this
, resolution be served on the said contractor and the said Surety
'Company by the City Engineer.
