DISTRICT.
Be it resolved by the Board of Commissioners of Salt Lake City,
Utah:
SECTION 1. The Board of Commissioners of Salt Lake City, Salt
Lake County, Utah, has determined and hereby determines that it will
be in the best interest of said city to grade, construct curb and
gutter (where not now built), as specified on the plans, specifications
and profiles on file in the office of the City Engineer, a drainage
system, sidewalks, and streets to be paved with a 2-inch thick stone-
filled sheet asphalt wearing surface placed on a 6-inch thick compacted
gravel base, or a 2/-inch thick stonefilled sheet asphalt wearing
surface placed on an 8-inch thick compacted gravel base; the said streets
to be improved and the boundaries of said Curb and Gutter Extension
Improvement District, all more particularly described in the Notice of
Intentiontn construct the proposed improvements hereinafter set forth.
SECTION 2. The proposed district shall be known as Curb and
Gutter Extension No. 426 of Salt Lake City, Salt Lake County, Utah.
SECTION 3. The City shall pay the cost and expenses of improvement
to be constructed on streets and avenues on property owned by said city.

Such part of the cost and expenses of the proposed improvem,nts
as is not paid by the city shall be assessed against the lots and lands,
adjoining, abutting, contiguous or adjacent to the proposed improvements.
SECTION 4. Written protests against the proposed improvements or
against the creation of said district must be presented and filed in
the office of the City Recorder on or before the 27th day of
July , 1971, at the hour of 5.00 o'clock p.m. and
on the 28th day of July 10.00

o'clock a.m., at the City Hall of said city, such protests shall be
heard and considered by the Board of Commissioners. The City Recorder
is hereby directed to give notice of intention to make the proposed
improvements and of the time within which protests against the proposed
improvements or the creation of said district may be filed and the
date when such protests will be heard and considered, by publication in
a newspaper having general circulation in Salt Lake City, said notice
to be published at least four times, once during each week for four
successive weeks, the last publication to be at least five (5) days,
but not more than twenty days prior to the time designated in such
notice within which protests must be filed, and by mailing said notice
by United States mail, postage prepaid, to each owner of land to be
assessed within the proposed special improvement district, at the
last known address of such owner, using for such purpose the names and
addresses appearing on the last completed real property assessment
rolls of Salt Lake County and, in addition, by so mailing a copy of
said notice addressed to "Owner" at the street number of each piece
of improved property to be affected by the assessment. Said notices
shall be mailed not later than ten days after the first publication
of such notice. The City Recorder shall have on file in his office a
copy of the Notice of Intention for the examination of any interested
parties. Said notice shall be in the following form,to-wit:
NOTICE
NOTICE IS HEREBY GIVEN by the Board of Commissioners of Salt Lake
City, Utah, of the intention of such 'oard of Commissioners to make the
following described improvements:
To construct sidewalks and standard curb and gutter where they do
not now exist; all streets in the extension to be paved with a 2-inch
thick stonefilled sheet asphalt wearing surface placed on a 6-inch
thick compacted gravel base, or a 21/2-inch thick stonefilled sheet
asphalt wearing surface placed on an 8-inch thick compacted gravel base;
to construct a drainage system; to remove trees where they are in the
way of new improvements; to remove all existing nonconforming improve-
ments in the way of new improvements; to construct driveways from the
new curb and gutter to the street edge of sidewalks and to do all other
work necessary to complete the project in accordance with Salt Lake
City Standards.
All of the frontage of streets in this district upon which improve-
ments are to be made will be assessed in accordance with the improvements
constructed. Credit under proper permits from the office of the City
Engineer and extensions previously built and assessed will be made and
allowed so that the property will not be reassessed for those prior
improvements so constructed. Credits for corner lot exemptions or
partial exemptions will be made as provided by State Statutes and City
Ordinances.
This extension will be constructed within the following described
area and boundaries and upon the following named streets:
AREA: Sixth East Subdivision Forest Dale Plat "A" Subdivision,
Forest Dale Subdivision, Glenwood Subdivision, Wilmington
Subdivision, Lots 7, 8, 10, 11, 5 and 14. All in Block
43, 10 Acre Plat "A", Big Field Survey,; Forest Dale
Subdivision, Lots 6, 9, 10 and 13 and all in Block 44,
10 Acre Plat "A", Big Field Survey, Fairmount Springs
Addition, Geneva Place Subdivision, Lots 7, 8, 11 and 12,
all in Block 45, 10 Acre Plat "A", Big Field Survey;
Granite Subdivision Plat "A", Lot 8, Block 46, 10 Acre
Plat "A", Big Field Survey, together with all other
pertinent portions and parcels of property not particu-
larly divided, all in Sections 19 and 20, T.1 S., R.1 E.,
Salt Lake Base and Meridian.

All other things necessary shall be done to complete the whole
project in a proper and workmanlike manner according to plans, profiles
and specifications on file in the office of the Salt Lake City Engineer,
and to defray the abutter's portion of the cost and the expense of said
improvements by a special tax or assessment to be paid in ten (10) equal
annual installments plus seven percent (7%) interest on the unpaid
balance levied according to the front or linear foot frontage upon and
against all lots, pieces or parcels of land to be benefited and affected
by said improvements. The whole amount of the tax may be paid without
interest within 15 days after notification by the Salt Lake City Treasurer
of the amount due.
All non-conforming improvements such as lawns, sprinkling systems,
rock gardens, driveways, curbs, gutters, culverts, walks, fences, etc.,
which have been built or installed by abutting property owners within
the areas to be improved, must be removed by the property owners, or at
their expense, prior to the commencement of the project. If these
improvements are not removed by the property owners, they will be removed
by the contractor and disposed of by him as directed by the Engineer.
Parking areas, i.e., those areas between the back of new curb and
the street edges of existing sidewalk, not occupied by housewalks or
driveways, will be brought to finished grade using the existing soil.
No fine grading, top soiling, seeding, sodding, or installing of sprinkling
systems will be done under this improvement extension.
The Abutter's Estimated Cost per front foot does not include the
cost of driveways which will vary according to width and amount of
parking area to be covered. These costs are estimated to be approximately

$1.00 per square foot for open-type driveways and $1.50 per square
foot for drives requiring pipe or culvert in the gutter line. The
cost of driveways will be assessed against the properties benefited
in addition to the assessment for sidewalk, curb and gutter, paving
and miscellaneous.
The Estimated Cost of the City's portion proper and Class 'C'
consists of the cost of one-half of all general excavation; the cost
of the paving of all intersections, the cost of paving a 4' strip
along Elm Avenue, between 9th East and McClelland Street; a 4' strip
along Wilmington Avenue, between 6th East Street and 7th East Street;
a 4' strip along Simpson Avenue between 9th East Street to Dead-end, a
6' foot strip along 5th East Street between 21st South Street and the
I-80 Freeway, a 4' strip along Ashton Avenue, between llth East Street
and Highland Drive, and 8' strip along Ashton Avenue, between 7th East
Street and 9th East Street, a 4' strip along 6th East Street between
21st South Street and I-90 Freeway, an 8' strip along Lake Street from
Ashton Avenue North to Dead-end, a 4' strip along Lincoln Street between
21st South Street and Railroad right of way, a 4' strip along 10th East
Street between 21st South Street and Railroad right of way, a 10' strip
along McClelland Street between Elm Avenue and Railroad right of way
and 14' strip along llth Beat Street between Simpson Avenue and Ashton
Avenue, the cost of all drainage and irrigation pipe and the cost of
removing and replacing existing sidewalks and curb and gutter made
necessary by the new improvements.
All protests and objects to the carrying out of such intention
must be presented in writing, signed by the owners of the property
affected or benefited, stating therein, lot, block or description of
property, together with the number of front feet (or square feet) to
the City Recorder on or before the 27th day of July
1971, The Board of Commissioners at its first regular meeting there-
after, to-wit, the 28th day of July , 1971, will consider
the proposed levy and hear and consider such protests and objections
to said improvements as have been made.
