A regular meeting of the City Commission of Salt Lake
City, Salt Lake County, Utah, was held on Tuesday, the
22nd day of May, 1979, at the hour of 10:00 a.m., at the
regular meeting place of said Commission, at which meeting
there were present and answering roll call the following
members who constituted a quorum:

following resolution in writing, which was read in its
entirety, and moved its adoption:
RESOLUTION NO. 31
A RESOLUTION DECLARING THE INTENTION OF THE
CITY COMMISSION OF SALT LAKE CITY, SALT LAKE
COUNTY, STATE OF UTAH, TO CONSTRUCT IMPROVE-
MENTS WITHIN SAID MUNICIPALITY, CONSISTING OF
CURB AND GUTTER, PAVING, STREET LIGHTS,
LANDSCAPING AND OTHER APPURTENANCES AND ALL
OTHER MISCELLANEOUS WORK NECESSARY TO COMPLETE
THE IMPROVEMENTS IN A PROPER WORKMANLIKE
MANNER; TO CREATE CURB AND GUTTER SPECIAL
IMPROVEMENT DISTRICT EXTENSION NO. 38-668;
TO DEFRAY THE COST AND EXPENSES OF SAID
IMPROVEMENT DISTRICT BY SPECIAL ASSESSMENTS
TO BE LEVIED AGAINST THE PROPERTY BENEFITED
BY SUCH IMPROVEMENTS; AND TO PROVIDE NOTICE
OF INTENTION TO AUTHORIZE SUCH IMPROVEMENTS
AND TO FIX A TIME AND PLACE FOR PROTESTS
AGAINST SUCH IMPROVEMENTS OR THE CREATION OF
SAID DISTRICT.

BE IT RESOLVED by the Board of Commissioners of Salt
Lake City, Salt Lake County, Utah:
Section 1. The City Commission of Salt Lake City,
Salt Lake County, Utah, hereby determines, that it will be
in the best interest of said Municipality to construct
improvements on 5600 West Street in Salt Lake City, including
curb and gutter, street excavation and paving, street lights,
landscaping and other appurtenances, and to complete the
whole in a proper and workmanlike manner according to plans,
profiles and specifications on file in the Office of the
Department of Public Works, 114 City and County Building,
Salt Lake City, Utah. The property to be improved and a
description of the proposed special improvement district are
more particularly described in the Notice of Intention to
construct the proposed improvements hereinafter set forth.
Section 2. The proposed district shall be known as
"Curb and Gutter Special Improvement District Extension
38-668."
Section 3. The cost and expenses of the proposed
improvements shall be paid by a special tax to be levied
against the property fronting or abutting upon or adjacent
to the improvements to be constructed which may be affected
or specially benefited by any of such improvements, such tax
to be paid in not more than ten (10) equal annual installments
with interest on the unpaid balance of not to exceed 10% per
annum until due and thereafter at the rate of 10o per annum
until paid. An allowance shall be made for corner lots, if
any, as provided by City ordinance so that such lots are not
assessed at full rate on both streets.
Section 4. Written protests against the proposed
improvements or against the creation of said District must
be presented and filed in the Office of the City Recorder on
or before the 20th day of1,.1 , 1979, at the hour of 5:00 p.m.

Thereafter at 10:00 a.m. on Thursday, the 21st day of June,
1979, at the Commission Chambers in Salt Lake City, Utah,
any such protests shall be heard and considered by the City
Commission. The City Recorder is hereby directed to give
notice of intention to make the proposed improvements and of
the time within which protests against the proposed improve-
ments or the creation of said District may be filed and the
date when such protests will be heard and considered by
publishing notice of intention to create Curb and Gutter
Special Improvement District Extension 38-669 in the Deseret
News, a newspaper of general circulation in said Municipality,
said notice to be published at least four times, once during
each week for four consecutive weeks, the last publication
to be not less than five (5) nor more than twenty (20) days
prior to the time fixed in the notice as the last day for
the filing of protests. In addition, the City Recorder
shall mail a copy of such notice by United States Mail
postage prepaid to each owner of land to be assessed within
the proposed Special Improvement District at the last known
address of such owner, using for such purpose the names and
addresses of said owners appearing on the last completed
real property assessment rolls of Salt Lake County, and in
addition, a copy of such notice shall be mailed postage
prepaid addressed to "Owner" at the street number of each
piece of improved property to be affected by the assessment,
said notices to be so mailed not later than ten (10) days
after the first publication of the Notice of Intention.
Said Notice shall be in substantially the following form:

NOTICE OF INTENTION
PUBLIC NOTICE IS HEREBY GIVEN that on the 22nd day of
May, 1979, the Salt Lake City Commission adopted a resolu-
tion declaring its intention to create a special improvement
district to be known as Curb and Gutter Special Improvement
District Extension 38-668. It is the intention of the
Commission to make improvements within said Special Improve-
ment District and to levy special taxes as provided in
Chapter 16, Title 10, Utah Code Annotated, (1953) , as amended,
on the real estate lying within said District which is
benefited by such improvements.
DESCRIPTION OF DISTRICT
The area of the proposed improvement district is all
within the limits of Salt Lake City, as follows:
Northeast 1/4 of Section 35 Township 1
North, Range 2 West, SLB&M Northwest
1/4 of Section 36 Township 1 North,
Range 2 West, SLB&id.
The street to be improved is:
5600 West Street (Eddy Rickenbacker
Drive) from Amelia Earhart Drive to the
North Section Line of Sections 35 and
36, Township 1 North, Range 2 West,
SLB&M.
INTENDED IMPROVEMENTS
The improvements to be constructed within said Special
Improvement District in general include the construction of

curb and gutter, asphalt paving, raised median, street
lighting, landscaping, excavation, grading and the preparation
of the street area to receive the proposed improvements, and
all other miscellaneous work necessary to complete the work
in a proper workmanlike manner.
It is intended that the improvements be constructed in
the area designated by the following boundaries:
North - North Section Line of Sections
35 and 36
South - Amelia Earhart Drive
West - West property line of
5600 West Street
East - East property line of
5600 West Street
PROPERTY TO BE ASSESSED
The parcels of real property within the Improvement
District which shall be specially benefited by the improve-
ments to be constructed and which shall be assessed therefor
are described as follows:
5600 WEST STREET - EAST SIDE:
Parcel 1
The West 200 feet of Lot 1, Salt Lake International
Center, Plat 5, an industrial subdivision of part of
Section 36, T.1N., R.2W., SLB&M.
Frontage = 891.00 feet.

A parcel of land located in the Northwest 1/4 of
Section 36, T.1N., R.2W., SLB&M, being more particu-
larly described as follows:
BEGINNING at a point which lies 1367.97 feet
South and 54.85 feet East of the Northwest corner
of said Section 36, and running thence North
0°02'54" East 357.04 feet to the point of curvature
to a 30 foot radius curve; thence Northeasterly
47.08 feet along the arc of said curve to the
right, thence North 89°58' East 170.04 feet; thence

ESTIMATED COST OF IMPROVEMENTS
The total cost of improvements in said proposed Special
Improvement District as estimated by the Engineering Division
of the Department of Public Works is approximately $635,000.00,
the total amount of which shall be paid by a special tax to
be levied against the property which may be affected or
specifically benefited by such improvements. The property
owners' portion of the total estimated cost of the improve-

ments may be financed during the construction period by the
use of interim warrants. The interest on said warrants will
be assessed to the property owners. The estimated cost to be
assessed against the properties within said District shall

ASSESSMENTS AND LEVY OF TAXES
It is the intention of the City Commission of Salt Lake
City, Utah, to levy assessments as provided by the laws of
Utah on the eight parcels and lots of real property described
above, all of which are within the District. The purpose of
the assessment and levy is to pay those costs of the subject
improvements which the Municipality will not assume and pay.
The method of assessment shall be by front foot as set forth
herein.
The assessments may be paid by property owners in not
to exceed ten (10) annual installments with interest on the
unpaid balance at the rate or rates not to exceed ten percent

(10%) per annum as fixed by the City Commission, or the
whole or any part of the assessment may be paid without
interest within fifteen (15) days after the ordinance levying
the assessment becomes effective. The assessments shall be
levied according to the benefits to be derived by each
property to be assessed within the District. Other payment
provisions and enforcement remedies shall be in accordance
with Chapter 16 of Title 10 of Utah Code Annotated, (1953) ,
as amended.
A map of the proposed District, copies of plans, profiles
and specifications of the proposed improvements and other
related information are on file in the office of the Engineering
Division of the Department of Public 'Yorks, 401 City and
County Building, Salt Lake City, Utah, who will make such
information available to all interested persons.
TIME FOR FILING PROTESTS
Any person who is the owner of record of property to be
assessed in the Special Improvement District described in
this Notice of Intention shall have the right to file IN
WRITING a protest against the creation of said Special
Improvement District or to make any other objections relating
thereto. Protests shall describe or otherwise identify the
property owned of record by the person or persons making the
protest. Protests shall be filed with the City Recorder of

Salt Lake City, Utah, on or before 5:00 p.m. on the 20th day
of June, 1979. Thereafter at 10:00 a.m. on the 21st day of
June 1979, the City Commission will neet in public meeting
in the Commission Chambers to consider all protests so filed
and hear all objections relating to the proposed Special
Improvement District.
