BE IT KNOWN AND REMEMBERED: THAT the Board of County Commissioners of the County of Salt Lake, State of Utah, having met in regular session on the 31st day of May , 1978; and THAT the Board of City Commissioners of Salt Lake City, State of Utah, met in regular session on the -'/ day of ' ,.n , 1978. WITNESSET H: WHEREAS, LEAA Regulation No. 4100.1 (Appendix 2-2, 1.a) provide that not only 40 per cent of all federal funds granted under Part B of the Act to state law enforcement planning agencies be made available to units of local government to insure local participation in formulating, revising and updating the compre- hensive state plans, but also that in allocating these funds, the state planning agency must assure that major cities and counties within the state receive planning funds to develop comprehensive plans and coordinate functions at the local level; and WHEREAS, both Salt Lake City Corporation and the County of Salt Lake qualify as major cities and counties under the terms of said regulation and therefore are entitled to Part B planning funds under the Act unless specifically waived in writing; and WHEREAS, the regulations cited above further provide that where the largest county includes the largest city, a single, combined planning effort is expected; and WHEREAS, the regulations also provide that the state planning agency must make eligible governments directly aware of this eligibility and assure that funds are actually allocated to said governments unless specifically waived in writing; and WHEREAS, eligible cities and counties may authorize utilization of their direct shares by their regional or metropolitan planning units but are required to do so in writing; NOW, THEREFORE, BE IT RESOLVED that we, the undersigned, being duly elected and recognized officials of legally consti- tuted governmental entities entitled under the Act and the regu- lations to receive Part B planning funds for fiscal year 1979, and being fully apprised of the right and eligibility of the said funds, do hereby waive, forefeit and forego for and in behalf of the governmental units whom we are entitled to represent any and all right to said funds. BE IT FURTHER RESOLVED that we, the undersigned, authorize said Part B planning grant funds for fiscal year 1979 to be utilized for regionwide comprehensive planning in accord- ance with the rules and regulations as set forth by LEAA and by the Region XII Law Enforcement Planning Agency, Inc. It is hereby directed that the County Clerk of Salt Lake County be directed to forward a copy of this Resolution to the Region XII Law Enforcement Planning Agency, 175 East 2100 South, Box 15, Salt Lake City, Utah 84115.
