WHEREAS, The Board of Commissioners of this city has insti-
tuted proceedings to grade, curb and gutter with cement, and
construct a drainage system in the territory between the south
side of Third Avenue and the north side of Eleventh Avenue, and
the east side of Canyon Road and the east side of H Street, the

same being Curb and Gutter Extension No. 20; and
WHEREAS, William McIntyre and forty-seven other owners of
property in the district aforesaid have commenced an action in
the Third District Court against Salt Lake City, and have obtaine.
en injunction against the city and everybody connected with it,
restraining them from proceeding with such improvement; and
WHEREAS, The city's portion of the cost of such improvement
about
would be 452,000.00, which money can be used to good advantage in
making other improvements, particularly in adding to the water
supply of Salt Lake City:
NOW THEREFORE, Be it resolved that no defense be interposed
by the Law Department to the action aforesaid, and that no furthe
proceedings toward making the improvement aforesaid be taken, and
the amount of the city's portion aforesaid be transferred and
appropriated to the Department of rater Supply and Waterworks for
water supply. , .
