Dear Sir:
At a meeting of the Board of Commissioners held June
5, 1957, Resolution No. 4 authorizing proceedings to be brought
in the name of Salt Lake City by its Legal Department to determine
what interest or ownership, if any, Arthur N. Nielsen and Vera R.
Nielsen, his wife, may have in land in Lot 11, Blk. 6, 5 Acre Plat
'C', Big Field Survey, more particularly described therein, and if
adjudged that they have some interest or ownership, to acquire
such interest or ownership by such proceedings for street improve-
ments on 17th South between 21st and 23d Cast Streets, was adopted.

RESOLUTION
Result
WHEREAS, it is necessary in order to safely and Properly provide
for the traffic, pedestrian and vehicular, using, and to use, 17th South
Street between 21st East and 23rd East Streets in Salt Lake City to
improve the same by installing sidewalks and curbs and gutters and hard
surfacing the street between the gutters; and,
WHEREAS, there has already been legally created an improvement district
for the installation of sidewalks and curbs and gutters and hard surfacing
streets, which improvement district includes the portion of 17th South Street
above referred to, the plans and specifications for which have been approved
by the Board of City Commissioners and the actual work of installing said
sidewalks and curbs and gutters and hard surfacing streets has been com-
menced; and,
WHEREAS, it appears that Arthur H. Nielsen and Vera R. Nielsen, his
wife, who own property abutting said 17th South Street within the limits
so to be improved claim they own and hold an interest in a part of the
area comprising said 17th South Street hereinafter described, and it is
necessary that it be judicially determined whether they own or hold any
interest therein and to condemn such interest, if any, before said pro-
ject can proceed:
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COREIS STONERS OF SALT
LAKE CITY, that it is necessary to the public interest of said City and
its inhabitants that the City proceed with the improvements above referred
to in said improvement district by installing sidewalks and curbs and
gutters and hard surfacing said 17th South Street, and that it is necessary
in order to proceed with said improvements, to include within the area of
17th South Street the strip of land hereinafter described, and which is
hereby found and claimed to be a part of said street;
That said strip of land is necessary to the proper improvement of

said 17th South Street, and is hereby declared to be a public necessity
and for the good, well-being and protection of the inhabitants of said City;
That proceedings be, and hereby are, authorized to be brought in the
name of Salt Lake City by the Legal Department of Salt Lake City to
determine what interest or ownership, if any, said Arthur H. Nielsen and
Vera R. Nielsen, his wife, may have and hold in said land hereinafter
described, and, if it be adjudged that they have some interest or ownership
therein, to acquire such interest or ownership by such proceedings for the
proper and necessary improvement of said 17th South Street as aforesaid,
and to obtain immediate right of entry thereon and immediate possession
thereof.
The land hereinabove referred to and authorized to be made the subject
of said proceeding is situated in Salt Lake County, State of Utah, and
particularly described as follows:
Commencing at a point S 89° 52' East 419.54 ft. from the
N.W. corner of Lot 11, Block 6, 5 Acre Plat C, Big Field
Survey; thence S 89° 52' E 410.36 ft.; thence N 89° 18'
29" W 410.38 ft.; thence S 00° 11' 48" W 4.00 ft. to the
point of beginning, containing 820.66 sq. ft. or .0188 acres.
Passed by the Board of Commissioners of Salt Lake City, Utah, this
5th day of June, 1957.
