RESOLUTION OPPOSING THE LOCATION OF A COMMUNTIY CORPECTION
CENTER AT THE SITE OF THE TOWER MOTEL, 1009 SOUTH STATE STREET,
SALT LAKE CITY, UTAH.
WHEREAS, the Board of Commissioners of Salt Lake City has
been informed of the desire of the State of Utah, through its
Division of Corrections, to relocate a Community Correction
Center to the site of the Tower Motel at 1009 South State for
purposes of operating a halfway house for inmates of the Utah
State Prison; and
WHEREAS, the Hoard of Commissioners is informed that it. is
the intent that such Correction Center would accommodate forty-
eight inmates, together with a fulltime staff and security force,
but provide only five parking spaces; and
WHEREAS, the location itself, as a motel , is a nonconforming
use due to substandard parking facilities, the inadequacy of
which will he accentuated by change to a halfway house with full-
time staff, security, inmate and visitor needs for parking; and
WHEREAS, the streets adjoining the proposed halfway house
site (which provide access to the residential community) are
inadequate to handle the existing burdens of parking, let alone
any additional demands that may he generated by an increase in
the need for parking associated with such a change in use; and
WHEREAS, the private property owners of the Tower Motel are
hound by law to comply with the applicable zoning ordinances; and
WHEREAS, the site of the Tower Motel at 1009 South State
Street, located in a Commercial C-3 District, is actually
adjacent to and an integral part of the residential South Central
Community of Salt Lake City, a high density neighborhood
inhabited largely by relatively helpless and fearful senior citi-
zens; and
WHEREAS, the block in which such halfway house is proposed
to be located has thirty existing homes and a trailer court,
which has between fifty to seventy mobile homes; thus there are
over a hundred dwelling units within said block; and
WHEREAS, in this particular location, there is no buffer
zone between the Commercial C-3 District and the Residential R-2
District directly abutting it; and
WHEREAS, the City is concerned for the safety of the resi-
dents of this neighborhood; and
WHEREAS, this South Central Community of the City already
bears more than its fair share of group homes and other residen-
tial-type alternative treatment locations for individuals
receiving treatment as part of or in lieu of institutionali-
zation; and
WHEREAS, there are numerous locations for such halfway house
facilities within the Salt Lake Valley and this State other than
the Tower Motel site, which could adequately serve the public
purposes served by halfway houses and the needs of the inmates
who are attempting to adjust and re-enter society, without
creating the drastic impact upon this high density neighborhood;
and
WHEREAS, as a matter of public policy, the State of Utah
should not consider any action which disregards the valid and
existing zoning ordinances of local -iurisdictions; rather, it
should encourage all public and private entities to comply with
applicable local ordinances, to protect and to preserve proper
planning and zoning for our local communities.
NOW, THEREFORE, RE IT RESOLVED, that the Board of Commis-
sioners of Salt Lake City, hereby expresses its support for the
residents of the South Central Community Council and other

residents located in the neighborhood surrounding 1000 South and
State Street in their opposition and objections to the proposed
Community Correction Center at 1009 South State Street, Salt Lake
City, Utah.
BE IT FURTHER RESOLVED that the Board of Salt Lake City
Commissioners urges the Division of Corrections of the State of
Utah to consider and comply with all local zoning and other
applicable ordinances of Salt Lake City when they deliberate
where to locate halfway houses or other such institutions.
BE IT FURTHER RESOLVED that the Division of Corrections be
informed of Salt Lake City's concern that the Division has not
fully evaluated the zoning and character of land and of the
impact of the proposed site upon abutting neighborhoods. In
considering any site, it should be aware of the impact where such
centers are in close proximity to residential districts. The
Division should further consider the location of other existing
residential group homes or institutions, serving public purposes,
located in that South Central City area so that this Community,
or any other does not hear an undue burden of more than its fair
share of such institutions.
BE IT FURTHER RESOLVED that a copy of this resolution be
forwarded by the City Recorder, to: (a) the Governor of the
State of Utah; (b) to the administrative head of the Division of
Corrections and the Social Services Department of the State of
Utah; (c) owners of the Tower Motel; and (d) the South Central
Community Council. The Recorder is further authorized to
publish and distribute this resolution as appropriate, to have
its provisions adopted by the State of Utah.
