Dear Mr. Hogensen:
I have the copy of the Resolution of the
City Commission which you forwarded with your
letter of September 3rd. This Resolution asks
me to place certain gun legislation on the agenda
of the next session of the Legislature. The next
session of the Legislature will be the Budget
Session, meeting in January of 1972. The Governor
has no authority to place non-budgetary matters on
the agenda of this session. This can be done only
by a Resolution of the Legislature itself, concurred
in by 2/3 of the members of each house.
I am, therefore, forwarding a copy of the
Resolution to the Legislative Council for their
consideration.

RESOLUTION
Result . . .
WHEREAS, the use of guns and firearms in the commission of
felonious acts is rapidly increasing; and
WHEREAS, federal and state laws dealing with the registration
of firearms have not been effective in reducing the use of firearms in
the commission of felonious acts within Salt Lake City and the State
of Utah nor the United States of America; and
WHEREAS, the use of firearms in the commission of felonious
acts constitutes an extreme hazard to the life and well-being of the
citizens of this city, state and nation; and
WHEREAS, the penalties for the wrongful use of firearms should
be assessed against the minority of persons so abusing their privilege
to own and possess firearms and not against the overwhelming majority
of citizens who respect the law and their constitutional right to bear
arms; and
WHEREAS, there is presently no statutory prohibition against the
possession of firearms by persons who have previously been convicted of
felonies involving the use of firearms; and
WHEREAS, the present penalties for the use of firearms or other
deadly weapons in the commission of felonies are inadequate for the pro-
tection of the public;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF
SALT LAKE CITY, UTAH, that the Honorable Calvin L. Rampton, Governor
of the State of Utah be, and hereby is, requested on behalf of the citi-
zens of Salt Lake City to include in his next message to the state leg-
islature (1) the passage of legislation making it a felony for any person
who has been convicted of a crime involving the use or purported use of
a gun, pistol, target gun or other firearm or deadly weapon to thereafter
have in his possession any gun, pistol, target gun or other firearm or any
facsimile thereof and imposing severe penalties for the violations thereof,
and (2) the passage of legislation increasing penalties for the use of
firearms or other deadly weapons in the commission of felonies within the
State of Utah.
BE IT FURTHER RESOLVED BY THE BOARD OF COMMISSIONERS OF SALT
LAKE CITY, UTAH, that copies of this resolution be mailed to the Governor
of this State, the Speaker of the House of Representatives and the Pres-
ident of the Senate of the Utah Legislature and all members of Congress
from the State of Utah.
Passed by the Board of Commissioners of Salt Lake City, Utah
this 31st day of August, 1971.
