The Summary of Tabulation and List of Protestors prepared by the City Engineer submitted in connection with Curb and Gutter Extension No. 684 which was presented to the Public Works Committee is attached as "Exhibit A". Consistent with past City policy and the recommendation of the Public Works Committee and the City Engineer, all streets where the protests total 50% or more shall be deleted from this Improvement District. In addition "F" Street where the protests totalled 30.8% of the front footage of the street but 100% of the front footage property of homeowners on the Street, shall be deleted. The streets to be deleted from the District as proposed in the Notice of Intention are as follows: 800 East Street Imperial Street Atkin Avenue 30th South Street Yuma Street Kenwood Street 12th East Street 21st East Street 10th Avenue ("L" Street to "M" Street) 10th Avenue ("B" Street to dead end) "A" Street "E" Street "F" Street "H" Street "M" Street 12th Avenue ("D" Street to "F" Street) Jeremy Street Thereupon, Councilmember Parker introduced a Cn resolution to create the Salt Lake City, Utah Curb and Gutter tt.) Cn Q) Extension No. 684 as defined in the Notice of Intention after deleting the streets listed above and moved its adoption. Parker NAY: None The resolution reads as follows: A RESOLUTION TO CREATE SALT LAKE CITY, UTAH CURB AND GUTTER EXTENSION NO. 684, TO AUTHORIZE CONSTRUCTION OF IMPROVEMENTS AND TO AWARD CONSTRUCTION CONTRACTS AS SET FORTH IN THE NOTICE OF INTENTION TO CREATE THE CURB AND GUTTER EXTENSION. BE IT RESOLVED by the City Council of Salt Lake City, Salt Lake County, Utah: Section 1. It will be in the best interest of said Municipality to construct the improvements identified and described in the Notice of Intention concerning the Salt Lake City, Utah, Curb and Gutter Extension No. 684 which Notice has been published and mailed as required by law. However, the 0 streets which are listed above and which were designated in the Cn Notice of Intention have been deleted from the District and CJt CD will not be included in the District when it is created. CD CD CD -3- Section 2. The City Council has heretofore considered each and every protest filed and has heard each and every person who wished to be heard in protest against the creation of this Curb and Gutter Extension District or the construction of any of the improvements therein or on any other matter pertinent to said Curb and Gutter Extension. Modifications of the District have been made in response to such protests and in accordance with the recommendations of the Engineering Department and the Public Works Committee. Section 3. The Special Improvement District comprised of the properties abutting streets designated in the Notice of Intention after deletion of the above-listed streets is hereby created and the construction of improvements as proposed in the Notice of Intention pertaining to said streets is hereby authorized. Section 4. As further modification of the Notice of Intention, the cost of improvements designated in the Notice of Intention for the south side of 700 North between Morton Drive and the east side of the right of way for 1-215 and the east side of 1100 East running from Zenith Avenue south approximately 257.22 feet, shall become part of the City's portion of expenses of the District. This change is a result of Cn the determination that the proposed improvements do not tV Cn Cr) benefit directly the frontage of the abutting properties because only the rear yards of the properties adjoin the CO proposed improvements. -4- Section 5. The City Recorder is hereby authorized and directed to file a copy of the Notice of Intention and resolution creating the District as finally approved in the Salt Lake County Recorder's office within five days from the date hereof. Smith Inc. submitted the lowest bid for the construction of the improvements in areas A and C and King Con Inc. submitted the lowest bid for the construction of improvements in area B, all as specified in the Notice of Intention and in the engineering plans for said Curb and Gutter District. The City Engineer recommended acceptance of such bids for construction of the improvements in the 0, District as modified by deletion of the above-listed streets. The reduction in the size of the District will result in a lower h.) C7T CD aggregate construction cost, but the lowest bidders have assured the City Engineer that the unit price upon which the Co bids were based will not be increased. CD -7- Thereupon Councilmember rarker introduced the following resolution in writing, which was read in its entirety, and moved its adoption: co Cn Ch 0, _$_ RESOLUTION NO. 44 WHEREAS, it now appears that the lowest responsible bids for the construction of the improvements specified in the Notice of Intention of the Salt Lake City, Utah Curb and Gutter District No. 684, subject to the deletion of streets as set out above, were made by Z.P. Smith Inc. as to areas A and C and King Con Inc. as to area B: THEREFORE, the contracts for the construction of said improvements in said District is hereby awarded to Z.P. Smith Inc. as to areas A and C and King Con Inc. as to area B. in accordance with their proposals. The exact amount to be paid under these contracts shall be determined by computation of the work done based upon the unit prices as set forth in the bids. The Mayor is hereby authorized to execute contracts between Salt Lake City and the successful bidders, which contracts may include work in addition to the improvements to be constructed within said Special Improvement District. The petition was signed with the understanding that it was NOT to oppose the improvement of these streets. The signatures were against the cost involved. Mr. Koplin, who circulated the petition, made it very clear that, we who signed the petition, could obtain private contractors who could do the equivalent work for a fraction of the cost quoted to us. We now realize that this was a fallacy and that a bid has been submitted and accepted by the council of a 19% decrease of the original cost first quoted. We would, therefore, like to remove our names off of Mr. Koplins' petition that was misrepresented and which would oppose the project. We are, indeed, FOR the improvement of the street. We would like to see the improvements made and have Van Buren Ave and Navajo Street a safer and more comfortable street on which to live. Thank you very much. Tel (BOl)535 7677672 May 21, 1981 i 1 SUBJECT: Protests for Curb and Gutter District No. 38-684 (Addendum No. 2) Pursuant to the Public Works Committee Meeting of May 14, 1981, this office has made further study of the subject project in an effort to answer questions raised at the meeting. Some of the protests received on both 700 North and 1100 East Streets have concerned the fact the back of lots are being assessed for improvements. In these situations the lots front on another street which has already been im- proved with curb and gutter, and this has resulted in cases whereby property owners are paying for improvements on both sides of their lots, but usually not benefiting from those improvements on the rear portion. In the past the City's policy on this has been to assess these property owners regardless of whether they front or back onto the improvement district. Since this only comes up ocassionally, the problem has not been significant enough to warrant action by the City. In reviewing this situation now, where the improvement is still needed (and desired by the City) to complete the street, as is the case on 11th East and on 700 North, it would be reasonable to allow the assessment of this frontage for these properties to be assumed by the City. It is therefore the recommendation that these assessments be assumed by the City. They amount to the following: 700 North Street - 498.16 feet @ $41.20 per foot = $20,525.00 llth East Street - 251.2 feet @ $46.69 per foot = $11,729.00 Total $32,254.00 0 cn These figures are based on the preliminary estimates. The actual costs Crh should be less because the low bidder for the project was considerably below the Cr) engineer's estimate. Although it is questioned whether or not F.A.A. will pay their assessment because of their governmental status, it is desired by the City to complete the improvements on their frontage, thereby completing the full improvement of 700 North. The protest rate therefore for 700 North would be less than 50% and it is recommended that the 700 North remain in the curb and gutter district. I therefore recommend that the Public Works Committee authorize ap- proval of the resolution creating Curb and Gutter District No. 38-684 as amended and recommending award of the contract to the low bidder. Consistent with past City policy and the recommendation of the Public Works Committee and the City Engineer, all streets where the protests total 50% or more shall be deleted from this Improvement District. In addition "F" Street where the protests totalled 30.8% of the front footage of the street but 100% of the front footage property of homeowners on the Street, shall be deleted. BE IT RESOLVED by the City Council of Salt Lake City, Salt Lake County, Utah: Section 1. It will be in the best interest of said Municipality to construct the improvements identified and described in the Notice of Intention concerning the Salt Lake City, Utah, Curb and Gutter Extension No. 684 which Notice has been published and mailed as required by law. The City Council has heretofore considered each and every protest filed and has heard each and every person who wished to be heard in protest against the creation of this Curb and Gutter Extension District or the construction of any of the improvements therein or on any other matter pertinent to said Curb and Gutter Extension. Modifications of the District have been made in response to such protests and in accordance with the recommendations of the Engineering Department and the Public Works Committee. Section 3. The Special Improvement District comprised of the properties abutting streets designated in the Notice of Intention after deletion of the above-listed streets is hereby created and the construction of improvements as proposed in the Notice of Intention pertaining to said streets is hereby authorized. Section 4. As further modification of the Notice of Intention, the cost of improvements designated in the Notice of Intention for the south side of 700 North between Morton Drive and the east side of the right of way for I-215 and the east side of 1100 East running from Zenith Avenue south approximately 257.22 feet, shall become part of the City's portion of expenses of the District. This change is a result of the determination that the proposed improvements do not benefit directly the frontage of the abutting properties because only the rear yards of the properties adjoin the proposed improvements. -4- Section 5. The City Recorder is hereby authorized and directed to file a copy of the Notice of Intention and resolution creating the District as finally approved in the Salt Lake County Recorder's office within five days from the date hereof. Smith Inc. submitted the lowest bid for the construction of the improvements in areas A and C and King Con Inc. submitted the lowest bid for the construction of improvements in area B, all as specified in the Notice of Intention and in the engineering plans for said Curb and Gutter District. The City Engineer recommended acceptance of such bids for construction of the improvements in the District as modified by deletion of the above-listed streets. The reduction in the size of the District will result in a lower aggregate construction cost, but the lowest bidders have assured the City Engineer that the unit price upon which the bids were based will not be increased. -7- Thereupon Councilmember Parker introduced the following resolution in writing, which was read in its entirety, and moved its adoption: -8- RESOLUTION NO. 44 WHEREAS, it now appears that the lowest responsible bids for the construction of the improvements specified in the Notice of Intention of the Salt Lake City, Utah Curb and Gutter District No. 684, subject to the deletion of streets as set out above, were made by Z.P. Smith Inc. as to areas A and C and King Con Inc. as to area B: THEREFORE, the contracts for the construction of said improvements in said District is hereby awarded to Z.P. Smith Inc. as to areas A and C and King Con Inc. as to area B. in accordance with their proposals. The exact amount to be paid under these contracts shall be determined by computation of the work done based upon the unit prices as set forth in the bids. The Mayor is hereby authorized to execute contracts between Salt Lake City and the successful bidders, which contracts may include work in addition to the improvements to be constructed within said Special Improvement District. The petition was signed with the understanding that it was NOT to oppose the improvement of these streets. The signatures were against the cost involved. Mr. Koplin, who circulated the petition, made it very clear that, we who signed the petition, could obtain private contractors who could do the equivalent work for a fraction of the cost quoted to us. We now realize that this was a fallacy and that a bid has been submitted and accepted by the council of a 19% decrease of the original cost first quoted. We would, therefore, like to remove our names off of Mr. Kopline' petition that was misrepresented and which would oppose the project. We are, indeed, FOR the improvement of the street. We would like to see the improvements made and have Van Buren Ave and Navajo Street a safer and rare comfortable street on which to live. Thank you very much. Some of the protests received on both 700 North and 1100 East Streets have concerned the fact the back of lots are being assessed for improvements. In these situations the lots front on another street which has already been im- proved with curb and gutter, and this has resulted in cases whereby property owners are paying for improvements on both sides of their lots, but usually not benefiting from those improvements on the rear portion. In the past the City's policy on this has been to assess these property owners regardless of whether they front or back onto the improvement district. Since this only comes up ocassionally, the problem has not been significant enough to warrant action by the City. In reviewing this situation now, where the improvement is still needed (and desired by the City) to complete the street, as is the case on llth East and on 700 North, it would be reasonable to allow the assessment of this frontage for these properties to be assumed by the City. It is therefore the recommendation that these assessments be assumed by the City. They amount to the following: 700 North Street - 498.16 feet @ $41.20 per foot = $20,525.00 11th East Street - 251.2 feet @ $46.69 per foot = $11,729.00 Total $32,254.00 These figures are based on the preliminary estimates. The actual costs should be less because the low bidder for the project was considerably below the engineer's estimate. Since the project has been scaled down considerably due to the high protest rate, the City has sufficient funds to assume the added cost. E-flBtT "A„ l� • May 21, 1981 Page 2 Based on this determination the only other protestor on 700 North Street is the Federal Aviation Agency. Although it is questioned whether or not F.A.A. will pay their assessment because of their governmental status, it is desired by the City to complete the improvements on their frontage, thereby completing the full improvement of 700 North. The protest rate therefore for 700 North would be less than 50% and it is recommended that the 700 North remain in the curb and gutter district. I therefore recommend that the Public Works Committee authorize ap- proval of the resolution creating Curb and Gutter District No. 38-684 as amended and recommending award of the contract to the low bidder.
