Result RESOLUTION
"WHEREAS, Salt Lake City has acquired certain
water rights in the Tanner Ditch leading from Big Cottonwood
Creek in Salt Lake County, and by virtue of a contract
heretofore made and entered into with the Big Cottonwood
Tanner Ditch Company, Salt Lake City has agreed to deliver
to said company certain waters from Utah Lake in exchange
for water from Big Cottonwood Creek, and
VPHEEAS, Salt Lake City contemplates and is now
negotiating other contracts of a similar nature for other
waters of Big Cottonwood Creek and Little Cottonwood Creek, and
WHEREAS, it is necessary in order to make said
exchange of waters to extend the East Jordan Canal, in which
canal Salt Lake City has an interest, for the purpose of
delivering water from Utah Lake to the said Tanner Ditch
Company and to such other persons as said City may contract
with for the exchange of waters, and
WHEREAS, it is and is hereby declared to be
necessary for said City to own the following described property
through which said East Jordan Canal, as extended, will run.
NOW THEREFORE BE IT RESOLVED, That the City Atterney
be, and he is hereby instructed and directed to bring suit
against the owners of the property hereinafter described,for
the purpose of acquiring title to said lands for Salt Lake
City by condemnation for said extension of the East Jordan

Canal, said lands being the following, to-wit:
Beginning 1145.76 feet west from the S.E.00rner
of the N.E.4 of Section 21 T. 2 S. , R. 1 E., Salt Lake Base
and Meridian; thence along a curve to the right radius
749.8 feet a distance of 243.92 feet; thence S. 66°21' W.
248.3 feet; thence along a curve to the left radius 683.8
feet a distance of 290.41 feet; thence south 42°01' W.
244.9 feet; thence N. 98.6 feet; thence N. 42°01' E. 171.64
feet; thence along a curve to the right radius 749.8 feet
a distance of 318.44 feet; thence N. 66° 21' E. 248.3 feet;
thence along a curve to the left radius 683.8 feet a distance
of 144.9 feet; thence east 104.6 feet to beginning.
Containing 1.447 acres more or less.
Beginning at a point S. 71°52' W. 2155.9 feet from
the northeast corner of the S. E. 4 of Section 21 T. 2 S.,
R. 1 E; Salt Lake Base and Meridian; thence S. 42° 01' W.
212.0 feet; thence along a curve to the right radius 606.7
feet, a distance of 344.1 feet; thence S. 74°31' W. 167.3
feet; thence N. 0°11' E. 68.55 feet; thence N. 74°31' E.
148.75' feet; thence along a curve to the left radius
540.70 feet, a distance of 306.6 feet; thence N. 42°01'
E. 152.3 feet; thence N. 89°52' E. 89.0 feet to beginning.
Containing 1.008 acres more or less.
Beginning 1145.76 feet West from the S. E. corner of
the N. E. 4 of Section 21, T. 2S., R. 1E., Salt Lake Base
and Meridian; thence West 104.6 feet; thence along a curve
to the left radius 683.8 feet, a distance of 140.5 feet;
thence N. 42° 26' E. 318.3 feet; thence East 89.4 feet;
thence S. 42° 26' W. 378.7 feet; thence along a curve to
the right radius 749.8, a distance of 69.0 feet to place of
beginning, containing .687 acres more or less.
and,
BE IT FURTHER RESOLVED, That said City Attorney be, and he
is hereby instructed to commence such proceedings at once.
In the opinion of the Board of Commissioners, it is
necessary to the peace, health and safety of the inhabitants of
Salt Lake City that this resolution become effective at once.
This resolution shall take effect upon its passage.
Passed by the Board of Commissioners of Salt Lake City,
