RESOLUTION OF INTENT
WHEREAS, the Federal Administration Aviation is relocating, as a
portion of the construction work and upgrading of the Salt Lake City
International Airport, the instrument landing system, which requires
the placing of a light pole on property owned by the Utah State
Highway Department; and
WHEREAS, a permit must be obtained from the Utah State Highway
Department to allow installation of said light pole; and
WHEREAS, as a condition of issuing said permit, the State requires
Permittee to indemnify and save the State harmless from any liability
which might arise because of the placing of the light pole; and
WHEREAS, the FAA attorneys will not allow the Federal Government
to agree to indemnify and save the State harmless from such liability;
and
WHEREAS, Salt Lake City is willing to indemnify and save the
State harmless from any such claims;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF
SALT LAKE CITY that it hereby expresses its intent to obtain the
required permit, to abide by the terms and conditions of said permit,
and to assign the same to the FAA in order that the instrument landing
system may be implemented.
The Board of Commissioners of Salt Lake City does hereby authorize
the procedure of obtaining the permit and agrees to accept the terms
and conditions as set forth therein. Said Board further authorizes the
Salt Lake Airport Manager, or his designated representative, to submit
an application on behalf of the City for said permit and to sign said
permit on behalf of the Salt Lake City Corporation.
Passed by the Board of Commissioners of Salt Lake City, Utah, this
7th day of August, 1974.
