RESOLUTION .
I
WHEREAS, By an ordinance duly passed by the Board of Commis-
isioners of Salt Lake City on April 17, 1912, as amended by an
Jordinance passed on October 18, 1912, the Denver and Rio Grande
Railroad Company was directed and required to construct at its own
expense a viaduct on Fourth South Street in Salt Lake City, east
and west on said street across said Company's railroad tracks
situated between the east side of Fifth rest Street and the west
iside of Sixth Vest Street; and
WHEREAS, The said Denver & Rio Grande Railroad Company has

Ilduly constructed the said viaduct according to the requirements of
the said ordinances to the satisfaction of the City Engineer and
the Board of Commissioners of Salt Lake City:
NO THEREFORE, Be it resolved by the Board of Commissioners of
Salt Lake City:
Ij That the said viaduct be, and it hereby is accepted by Salt
Lake City
; provided, however, that nothing in this resolution
shall be construed either as an exemption or release of the said
Denver & Rio Grande Railroad Company from liability for damage to
abutting property caused by the erection of the said viaduct and
its approaches, if it be hereafter determined that such property
has been damaged thereby, or as an assumption or recognition of
any liability on the part of Salt Lake City for such damage.
