WHEREAS, Salt Lake City has received a grant from the United States Envi- ronmental Protection Agency for completion of a sewer line extending along North Temple Street from Winifred Street to the Surplus Canal; and WHEREAS, the United States Environmental Protection Agency requires that an industrial cost recovery ordinance be enacted to recover a fair share of the grant amount from industrial users discharging process wastes into or through the North Temple Sewer Line; and WHEREAS, there are, at present, no industrial users discharging such pro- cess wastes into or through the North Temple Sewer Line; NOW, THEREFORE, be it resolved by the Board of Commissioners of Salt Lake City that an industrial cost recovery ordinance in conformance with the require- ments of 40 CFR 35 subpart E will be developed and enacted prior to but not later than the time that the first industrial user's process waste is introduced into or transmitted through the North Temple Sewer Line, provided said introduction or transmittal is made prior to the expiration of the industrial cost recovery per- iod as defined by 40 CFR 35.928-1 (b).
