'J Hogedenia sen ✓ 4,f� nnKi2) Qy " iihWiifnt ����`���V4 J u Phillips RESOLUTION Result If RESOLUTION URGING THE FEDERAL GOVERNMENT TO DESIGNATE THE LONE PEAK AREA AS A "SCENIC AREA" WHEREAS, Salt Lake City has been granted extraterritorial jurisdic- tion by the Legislature of the State of Utah in order to protect and main- tain a watershed for the residents of Salt Lake City; and WHEREAS, Salt Lake City has entered into several cooperative agree- ments with the Federal Government for the use and maintenance of these watershed areas for the benefit of the residents of Salt Lake City; and WHEREAS, the continued use and maintenance of Salt Lake City's water- shed areas is vital for the present and future water supply of Salt Lake City; and WHEREAS, the Lone Peak area constitutes a major part of the watershed of Salt Lake City; and WHEREAS, the Federal Government has proposed various alternative use designations of the Lone Peak area, all of which will to some degree affect the right, use and quality of Salt Lake City's watershed in this area; and WHEREAS, the Federal Government has solicited response from various groups and individuals and has held public hearings as to the desirability of the alternative proposed designations; and WHEREAS, it appears that the designation of the Lone Peak area as a "Scenic Area" would insure that the same Federal Agencies with which Salt Lake City now holds cooperative agreements regulating Salt Lake City watersheds, would continue to administer and manage these same portions of Salt Lake City's watershed; and WHEREAS, there appears to be no threat to the City's extraterritorial jurisdiction or the cooperative agreements now held concerning Salt Lake City's watershed by the adoption of said "Scenic Area" designation; and WHEREAS, there appears to be no intent in the regulations issued by the Federal Government to in any way preempt the rights of local juris- t -2- -a dictions to protect their watersheds under a "Scenic Area" designation; and WHEREAS, the "Scenic Area" designation allows for protection of water- sheds by local jurisdictions through the installation of adequate sanitary facilities for the capture and disposal of waste materials along with the development of the area as a recreational site; and WHEREAS, of all the proposed alternatives, a "Scenic Area" designa- tion for the Lone Peak area is the most consistent with the City's interest concerning its watershed. NOW, THEREFORE, be it resolved by the Board of Commissioners of Salt Lake City that inasmuch as the Federal Government has expressed its intent to classify the Lone Peak area as a recreational site, the City urges the Federal Government to adopt a "Scenic Area" designation for the Lone Peak area inasmuch as it will provide for the maximum control and protection of the watershed areas of Salt Lake City. BE IT FURTHER RESOLVED, that the City, in urging this designation for the Lone Peak area, does so with the firm understanding that it shall retain all rights, powers, and responsibilities to maintain its watershed as it currently possesses and enjoys by virtue of cooperative agreements with the various agencies of the Federal Government.
