RESOLUTION .
WHEREAS, The application of Samuel Scercelli for license to
conduct a saloon at No. 228 Test Third South Street was on April
25, 1913, approved by the District Court in and for Salt Lake
County, without a protest against the said application having been
made by authority of the Board of Commissioners owing to the fact
that the residents on Third South Street in the block where the
said saloon was proposed to be opened had no notice of said appli-
cation, and no opportunity to protest to the Board of Commission-
ers against the same until after the said application had been
granted; and
WHEREAS, Immediately after the granting of said application
al
by the District Court,4written protest/ against the licensing of a
saloon at the said location was presented to the Board of Commis-
sioners signed by the owners of about six hundred front feet on
West Third South Street between First West and Second West Street-,
and signed also by several hundred residents in the immediate
neighborhood of the proposed saloon; and
WHEREAS, It appears from the protests and communications so
filed with the Board of Commissioners that W est Third South Stre=t
between First Nest and Second Neat Streets now contains no saloon
on either side of the street, and is thickly settled with apart-
ment houses and small homes, and forms a neighborhood where the
'` presence of a saloon mi�;h A highly undesirable:
NOW THEREFORE, Be it resolved by the Board of Commissioners
of Salt Lake City, Utah, That the City Attorney is hereby instruc,ee
to apply to the Honorable District Court in and for Salt Lake
County to have the order heretofore entered granting a license to
the said Samuel Scarcelli to conduct a saloon at No. 228 West
Third South Street, vacated and set aside to the end that the
Board of Commissioners may give a hearing upon such application
to the parties interested, end t,eke such action in the premises
as in their discretion may seem expedient.
