Agraz Greener • \\, Hogensen Phillips RESOLUTION Result /7 RESOLUTION URGING AN AMENDMENT TO H.R. 3454, RESERVING IN SALT LAKE CITY THE POWER TO MANAGE THE WATERSHED IN THE PROPOSED LONE PEAK WILDERNESS AREA DESIGNATION OR, IN THE ALTERNATIVE, TO HAVE SAID AREA DESIGNATED A "SCENIC AREA." WHEREAS, on September 23, 1975 the Salt Lake City Board of Commissioners passed a Resolution requesting that the Lone Peak Area be declared a "Scenic Area"; and WHEREAS, said Resolution was passed because it was the Commission's opinion that said "Scenic Area" designation would permit the City to retain its rights, powers and responsibilities, necessary to maintain the Lone Peak Area as a protected watershed of Salt Lake City; and WHEREAS, the Safe Drinking Water Act known as Public Law 93-523 of the 93rd Congress imposes significant regulations on the quality of water distributed to the public, and for the City to comply with existing and expected water quality standards imposed by said Act, the City must be able to control its watersheds; and WHEREAS, the Lone Peak Area is an integral and significant part of Salt Lake City's water supply system, which serves the metropolitan Salt Lake City area and which provides water supply to more than 350,000 persons; and WHEREAS, wilderness designation would offer a permanent protection of the watershed and members of Congress have orally indicated a willingness to amend the Lone Peak Act in H.R. 3454, to reserve in Salt Lake City the power and right to manage and control this watershed; and WHEREAS, the City would support this area being designated as wilderness area, provided its powers and rights to manage the water- shed are guaranteed and reserved; NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Salt Lake City that such Board would support an act establishing wilderness in the Lone Peak area insofar as that act, with respect to the area known as the "Lone Peak Area," is reasonably consistent with • • -2- the following language. "Sec. 6. Notwithstanding any provision of this Act or the Wilderness Act, nothing therein contained shall be construed, applied or administered in a manner as to deprive Salt Lake City Corporation (or any successor) of the right to exercise extraterritorial jurisdiction and the right and power to manage and control the watershed contained in the Lone Peak Wilderness Area designation. It is recognized that said area is unique because of its proximity to a metropolitan community and the dependence of its population on water from this area. Congress hereby expressly recognizes and grants to Salt Lake City or any successor, the right to designate camping grounds, require sanitary facili- ties or methods, require the removal of human or other waste, and otherwise reasonably direct the management of this watershed. The City's management and control shall include, but not be limited to the use of or authorizing the use of mechanized equipment, planes, helicopters or other equipment it deems necessary for the maintenance, construction or servicing of roads, reservoirs, streams, sanitary facilities, protection of water rights, reseeding fire damaged areas and fire prevention or suppression by chemical retardants or otherwise. Further, the City or any successor shall also have the right to authorize or direct limitations on the number of persons entering the area by permit or other reasonable means and enforce or implement State or City ordinances protecting watersheds or water quality. These rights shall be subject to coordination and cooperation with the Forest Service, but in nowise shall be construed to impose any financial or other duty or obligation on said City." BE IT FURTHER RESOLVED in the event that said grant of right to Salt Lake City is not included within the proposed Federal legislation, the Board of Salt Lake City Commissioners reaffirms its Resolution dated September 23, 1975 and its opinion that the said area should be designated a "Scenic Area," not a wilderness area. BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded by the City Recorder to all members of the Utah Congressional Delega- tion and that the City Water Commissioner be authorized to further publish and distribute this Resolution and otherwise seek to have its provisions adopted by Congress, as the will and opinion of the Board of Salt Lake City Commissioners.
