A regular meeting of the City Council of Salt Lake City,
Salt Lake County, Utah, was held on Tuesday, September 16,
1980, at the hour of 5:00 p.m. at its regular meeting place of
said Council, at which meeting there was present and
answering to roll call the following members who constituted
a quorum:
Ronald J. Whitehead Councilmember
Grant Mabey Councilmember

Thereupon the following proceedings, among others, were
duly had and taken:
At the City Council Meeting on September 9, 1980, the
City Engineer was asked to tabulate written protests and
report to the Public Works Committee of the Council at its
meeting on Thursday, September 11, 1980.
The following is the tabulation by the City Engineer of
written protests submitted in connection with Curb and Gutter
Extension No. 535 for owners of property situated on streets
within the District other than Parkway, Crystal and Whitlock
Avenues.

The protests received for Parkway Avenue, Crystal
Avenue, and Whitlock Avenue exceeded 50% of the total lineal
feet to be included in the Curb and Gutter Extension No. 535

for each street. Therefore, the City Council voted to delete
Parkway Avenue, Crystal Avenue, and Whitlock Avenue from the
District.
Thereupon, Councilmember Ronald J. Whitehead
introduced a resolution to create these Lake City, Utah
Curb and Gutter Extension No. 535 as defined in the Notice of
Intention and as subsequently revised and moved its adoption:
Connell Member Edward W. Parker seconded the motion to adopt
said Resolution. The Resolution was thereupon put to a vote
and unanimously adopted on the following recorded vote:

A RESOLUTION TO CREATE SALT LAKE CITY, UTAH CURB AND
GUTTER EXTENSION NO. 535, TO AUTHORIZE CONSTRUCTION OF
IMPROVEMENTS AND TO AWARD CONSTRUCTION CONTRACTS AS SET
FORTH IN THE NOTICE OF INTENTION TO CREATE THE CURB AND
GUTTER EXTENSION.
BE IT RESOLVED by the Mayor and City Recorder of Salt
Lake City, Salt Lake County, Utah:

Section 1. It will be in the best interest of said • •
Municipality to construct the improvements identified and
described in the Notice of Intention and subsequently revised
at this meeting concerning the Salt Lake City, Utah, Curb and
Gutter Extension No. 535 which Notice has been published and
mailed as required by law.
Section 2. The City Council has heretofore considered
each and every protest filed and has heard each and every
person who wished to be heard in protest against the creation
of the Curb and Gutter Extension or the construction of any
of the improvements therein or on any other matter pertinent
to said Curb and Gutter Extension. The protests have been
referred to the Engineering Department for tabulation and
recommendations.
Section 3. Improvements proposed and described in the
Notice of Intention to create said Curb and Gutter Extension
No. 535 and subsequent revisions made at this meeting are
hereby authorized, and Salt Lake City, Utah Curb and Gutter
Extension No. 535 is hereby created.

Thereupon, the City Recorder stated that notice to
contractors calling for bids for the construction of
improvements contemplated to be made in Salt Lake City, Utah,
Curb and Gutter Extension No. 535 has been published in the
Deseret News, a newspaper published and having general
circulation in said Municipality, at least one time at least
fifteen (15) days prior to the date specified in such notice
for the receipt of bids; that an affidavit of publication is
on file in the office of the City Recorder, that pursuant to
the notice to contractors, the following bids were received
in the office of the City Recorder up to 5:00 p.m. on
September 9, 1980, that being the time and date set for
receiving such bids:

After analyzing and tabulating the bids, it was
determined by the City Council that Z. P. Smith Inc. was the
lowest
boot bidder for the construction of the improvements
specified in the Notice of Intention and in the engineering
plans for said Curb and Gutter District, and the City
Engineer recommended acceptance of such bid.

Thereupon Councilmember Ronald J. Whitehead •
introduced the following resolution in writing, which was
read in its entirety, and moved its adoption:

RESOLUTION NO. 59
WHEREAS, it now appears that thetheoakt responsible bid
for the construction of the improvements specified in the
Notice of Intention and subsequently revised of the Salt Lake
City, Utah Curb and Gutter District No. 535 was made by Z. P.
Smith Inc. of Salt Lake City, Utah:
THEREFORE, the contract for the construction of said
improvements in said District is hereby awarded to Z. P.
Smith Inc. of Salt Lake City Utah, in accordance with its
proposal for a total contract price of approximately
$822,784.40 (for improvements of said Curb and Gutter
District), the exact amount to be determined from computation
of the work done on the unit price as set forth in the bid,
and the City Council is hereby authorized to execute a
contract between Salt Lake City and the successful bidder,
which contract may include work in addition to the
improvements to be constructed within said Special
Improvement District.
The resolution was seconded by
Council Member Edward W. Parker , and was adopted by vote of the
City Council as follows:
