WHEREAS, one M. Belle Rice, died in 1924 leaving a will
which will, among other matters, contain the following provisions:
"After the death of the said Helen C. Southwell,
Clara Simpson, Marguerite Rice, Marion Brown and
Helen Brown Hill, the said Bankers Trust Company, as
Trustee hereunder, out of the moneys and property in
its possession as Trustee shall cause to be erected
in the North, or Main entrance of Liberty Park, in
Salt Lake City, State of Utah, a suitable and appropriate
memorial Arch or entrance-way. Said memorial shall be
erected under the direction of said Trustee and shall be
approved of and accepted by said City. It shall bear
appropriate inscription as a memorial to Windsor Volney
Rice. The cost thereof, including plans therefor and
supervision in the erection thereof, shall not exceed
Fifty Thousand Dollars ($50,000.00)."
WHEREAS, the First Security Bank of Utah, N.A., is now the
successor to Bankers Trust Company as Trustee; and
WHEREAS, the Trustee and beneficiaries under said will, are
desirous of carrying out the provisions of said will regarding
the gift to Salt Lake City; and
WHEREAS, the Board of Commissioners of Salt Lake City are
desirous of accepting said gift and cause said memorial arch to
be erected, as provided in said will.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS
OF SALT LAKE CITY:
That said Salt Lake City accept, and by this resolution does
accept, the said $50,000.00 for the purpose of erecting a suitable
and appropriate memorial arch as called for in the last will and
testament of said M. Belle Rice.
