WHEREAS, the Federal Aviation Administration has advised the Salt Lake City Corpor- ation, Utah, that the Administrator of the Federal Aviation Administration has adopted a policy requirement that, as a condition to release any Salt Lake City International Airport land or property interest therein for subsequent sale from the terms and conditions in Grant Agreements dated July 2, 1958; August 14, 1958; January 21, 1959; July 28, 1959; May 18, 1960; August 2, 1960; August 21, 1962; June 27, 1963; July 29, 1964; July 20, 1965; June 23, 1966; June 27, 1967; July 9, 1968; April 8, 1969; December 30, 1969; May 23, 1972; April 25, 1973; and May 17, 1973, covering Federal-aid at said Salt Lake City International Airport (formerly called Salt Lake City Municipal Airport No. 1), the Salt Lake City Corporation, Utah, shall agree to expend a sum of $87,400 to be received from the sale of the hereinafter described land within a period of five (5) years from the date of sale of said land in accordance with certain priority categories set forth herein; WHEREAS, the City Commission of the Salt Lake City Corporation, Utah, has approved the sale of the hereinafter described land located at the Salt Lake City Inter- national Airport subject to its release for that purpose by the Federal Aviation Administration, and recognizes the need for the continued provisions of adequate public airport facilities to be provided the residents of Salt Lake City, Utah. NOW, THEREFORE, BE IT RESOLVED, by the City Commission of the Salt Lake City Corporation, Utah, that in consideration of the Federal Aviation Administration's approval and release for sale of the hereinafter described land and upon said sale the City Commission of the Salt Lake City Corporation, Utah, does hereby promise, covenant and agree with the Federal Aviation Administration to expend within five (5) years from the date of said sale, the sum of $87,400 within the following priority categories, it being understood and accepted that all currently needed development within the highest priority must be accomplished to the limit of said sum of $87,400 without Federal matching funds before improvements in the next category are begun: Priority A: Approved items of airport development set forth in FAR Part 152 (and as appropriate, in the NASP by priority of need) to be accomplished in accordance with currently applicable FAA design criteria. Priority B: Any aeronautical items of airport development ineligible under the ADAP. Priority C: Deposit to an identifiable account in a public fund for deferred use within a reasonable time for items in priority A and B above. Priority D: Retirement of airport bonds which are secured by pledges of airport revenue, including repayment of loans from other Federal agencies for such development. Priority E: Development of common use facilities and utilities of dedicated revenue production property of the airport. The land approved for sale subject to release by the Federal Aviation Administration is described as follows: A parcel of land in fee for a freeway known as Project No. 80-3, being part of an entire tract of property, in the NE4NW4, NWZNW4 of Section 4, T.1 S., R.1 W., S.L.B. & M. The boundaries of said parcel of land are described as follows: Beginning in the east boundary line of said entire tract at a point 85.0 ft. perpendicularly distant northwesterly from the center line of westbound North Temple relocation at Engineer Station 1252+94.91, said point of beginning is approximately 625 ft. west and 692 ft. south from the N4 corner of said Section 4; thence S. 61°43'30" W. 731.11 ft. 2. to a point of tangency with a 4498.66-foot radius curve to the right; thence Southwesterly 287.83 ft. along the arc of said curve to the west boundary line of said entire tract; thence South 138.50 ft.; thence East 203.0 ft.; thence S. 1°44'24" W. 15.48 ft.; thence East 361.20 ft.; thence N. 54°15'23" E. 416.20 ft. to a point 110.46 ft. perpendicularly distant southeasterly from the center line of eastbound North Temple relocation at Engineer Station 1349+83.69; thence North 385.30 ft. to the point of beginning as shown on the official map of said project on file in the office of the State Road Commission of Utah. The above described parcel of land contains 6.99 acres, more or less. BE IT FURTHER RESOLVED, by the City Commission of the Salt Lake City Corpora- tion, Utah, that the Mayor of Salt Lake City Corporation is hereby authorized and directed to accept an Instrument of Release from the Federal Aviation Admin- istration for the purpose of binding the Salt Lake City Corporation, Utah, to all its promises, covenants and agreements set forth in this Resolution. I HEREBY CERTIFY that the foregoing Resolution was introduced and read at a regular meeting of the City Commission of the Salt Lake City Corporation, Utah, on the (-""t day of "J� i i,c�i,t�c 1973, and was duly adopted at said meeting.
