COMMISSIONER
Authorizing the Part B planning grant
funds of the Act of State Law Enforce-
ment Planning Agencies for the fiscal
year 1975, to be utiliz ed for region-
wide comprehensive planning in accord-
ance with the rules and regulations
as set forth by LEAA by Region XII
Law Enforcement Planning Agency,
and waiving for and in behalf of the
governmental units whom Salt Lake
City Corporation is entitled to rep-
resent, any and all right to said funds

RESOLUTION AND WAIVER
WHEREAS, LEAA regulations (N 4100.1 Appendix 2-2,1.a) provide
that not only 40% of all Federal funds granted under Part B of the Act
of State Law Enforcement Planning Agencies be made available to units
of local government to insure local participation in formulating,
revising and updating the Comprehensive State Plans, but also that in
allocating these funds the State Planning Agency must assure that major
cities and counties within the State receive planning funds to develop
comprehensive plans and coordinate functions at the local level; and,
WHEREAS, both Salt Lake City Corporation and the County of
Salt Lake qualify as a major city and county under the terms of said
regulation, and therefore, are entitled to Part B planning funds under
the Act, unless specifically waived in writing; and,
WHEREAS, the regulations cited above further provide that where
the largest county includes the largest city, a single, combined plan-
ning effort is expected; and,
WHEREAS, the regulation also provides that the State Planning
Agency must make eligible governments directly aware of this eligi-
bility and assure that funds are actually allocated to such governments
unless specifically waived in writing; and,
WHEREAS, eligible cities and counties may authorize utilization
of their direct shares by their regional or metropolitan planning
units, but are required to do so in writing.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF
SALT LAKE CITY, UTAH, as the duly elected and recognized officials of
a legally constituted governmental entity entitled under the Act and the
Regulations to receive Part B planning funds for FY 1975, and being
fully appraised of the right and eligibility to said funds, do hereby
waive, forfeit and forego for and in behalf of the governmental units
whom we are entitled to represent, any and all right to said funds. We
authorize said Part B planning grant funds for FY 1975 to be utilized
for regionwide comprehensive planning in accordance with the rules and
regulations as set forth by LEAA by the REGION XII LAW ENFORCEMENT
PLANNING AGENCY.
BE IT FURTHER RESOLVED THAT THE City Recorder be directed to
forward a copy of this Resolution to the Region XII Law Enforcement
Planning Agency, Room 512, City and County Building, Salt Lake City,
Utah, 84111.
