RESOLUTI ON .
W"FTEREAS, Albert Herz has filed an application for a retail
liquor dealer's license at the Saltair Depot with the ..City Recorde
of this city; and
WHEREAS, Numerous persons, residents of the locality where
the license is sought to be used, and property owners and others
in the said neighborhood, have presented to the Board of Commis-
sioners of Salt Lake City protests against the granting of said
license; and
WHEREAS, The said Board notified the persons so protesting
and also the applicant for a license that said Board would hear
the matter in question at its regular meeting on Monday evening,
May 26, 1913; and
WHEREAS, There were present at said meeting said applicant fog
a licence and several of the protestants, all of whom made state-
ments 'favorable to and against the granting of Said liquor license;
and •
WHEREAS, It appears from the statements made at said meeting
that it is the intention of said applicant for a license to only
use his license during the season in which S altair Beach Resort
is open, and it is not his intention to sell liquors of any kind
by the drink at said place, but to sell the same, beer principal]. ,
by the bottle to persons going to Saltair; and
WHEREAS, It appears by the statements made at said meeting
that there are some five or six retail liquor dealers places with•'
a very short distance of Saltair Depot, and it also appears from
statements made at said meeting that the scheme contemplated by
the applicant for a license is to sell to persons going to Saltai
beer by the bottle, and issue to said persons a check or checks
for the bottle or bottles of beer purchased by them, which checks
would be honored at Saltair Beach, to rhich place said beer would
be transported by the railroad running from Salt Lake City to

Saltair Beach, which is in what is known as "dry territory", and
at which place no boor or other intoxicating liquor oe:n be lawfully
sold; and
•WHEREAS, the persons conducting retail liquor dealers places
above mentioned are required to, and do pay an annual license of
1500.00 to Salt Lake City, and that according to the statements
made at said meeting, said persons rely for the profits from their
business on the sale of liquors during the bathing season at
Saltair; and
WHEREAS, In view of the statements made at said meeting, the
Board of Commissioners are of the opinion that a license should
not be granted to the above named applicant because:
1. It seems to be an attempt to evade the law forbidding the
sale of intoxicating liquors at Saltair Beach, which is in what is
known as "dry territory".
2. That there are sufficient retail liquor dealers doing
business in the immediate vicinity of Saltair Depot to furnish
liquor to people rho desire to carry it to Saltair Beach.
3. That it is contrary to the Wishes of a large number of
property owners and residents in the immediate vicinity of the
place •::here said license is sought to be used.
4. That-the granting of said license would be unfair to the
retail liquor dealers above mentioned who pay an annual license of
0.500.00.
R0?'' THEREFORE, Be it resolved, that the Board of Commissioner:
of Salt Lake City recommend to the District Court of Salt Lake
County that the application of said Albert Herz for a retail liquo
dealers license at the place aforesaid, be denied, and that the
City Attorney of this city present to said District Court upon the
hearing of the application of said Albert Herz,for-a license, a
certified copy of this resolution, and in the name of the Board of
Commissioners of this city, protest against t anting of such
license.
