' -reets and— Public Improvements. 3 Result 1 1 RESOLUTION dHEREAS, in Paving Extension No. 113, contract for which was let to G. A. Heman on July 1, 1915, it is now necessary and expedient for the successful prosecution of this improvement that the Denver and Rio Grande Railroad Company proceed at once to pave that portion of Fourth West Street between First South and Second South Streets occupied by and adjacent to its railroad tracks on said Fourth +est Street, as required by the Statutes of the State of Utah and the ordinances of Salt Lake City; and WHEREAS, the said Railroad Company has been frequently notified and requested to proceed with the paving of said street according to law, and has failed and neglected to proceed with said paving: NOW THEREFORE, BE IT RESOLVED by the Board of Commission- ers of Salt Lake City that said Devner and Rio Grande Railroad Company is hereby directed and commanded to proceed forthwith with the paving of that part of the street aforesaid which it zc thc duty of the said company to pave under the law, and to complete the same within a reasonable time. BE IT FURTHER RESOLVED that a copy of this resolution be forthwith served upon the said Denver and Rio Grande Railroad Company; and BE IT FURTHER RESOLVED that if the said railroad company shall not,upon service of a copy of this resolution being made upon it, forthwith proceed to pave the street aforesaid as requir- ed by law, that the paving of the portion of said street required by law to be done by the said railroad company shall be forthwith done by the City of Salt Lake and the cost and expense of such paving be collected by levy and sale of the property of said rail- road company in the manner provided by law.
