Harmsen Harrison MIN Phillips /��'!-!-� �■`/ RESOLUTION Result WHEREAS, Salt Lake City Corporation has granted permission over a period of many years for the construction of underground vaults or space on Main Street and other streets of the city; and WHEREAS, the contemplated special improvements on Main Street will require the strengthening and, in some cases, the replacement of such underground vaults or space to support said street improve- ments; and WHEREAS, the present Board of Commissioners of Salt Lake City is not inclined to impose a rental fee or other charge upon the occupants of such underground vaults or space but is of the opinion that such occupants must pay the costs of strengthening and/or replacing such underground vaults or space as a condition precedent to their con- tinued occupancy; and WHEREAS, the continued license and permission to occupy such underground vaults and space in the city streets should be granted with the express understanding that the occupants thereof shall not obtain any legal or equitable interest in the streets which cannot be terminated at any time by the city; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF SALT LAKE CITY: 1. That the present occupants of underground vaults or space in Main Street shall, upon strengthening and/or replacing such vaults or space in accordance with the requirements of the Salt Lake City Engineer to support contemplated street improvements on Main Street, be granted a continuing revocable license to occupy such underground vaults or space in said street without payment of rent for such areas subject to the right of any future governing body of Salt Lake City to impose such rental in which event it is the desire of the under- signed that whatever moneys have been expended for strengthening and/or replacement of such underground vaults or space in accordance herewith be taken into consideration in determining the amount of any future rentals. 2. That the revocable license and permission hereby granted for the continued occupancy of such underground vaults and space is subject to the express understanding and condition that the occupants thereof shall obtain no legal or equitable interest in said Main Street and the license and permission so granted may be terminated by the city at any time.
