G er • all ✓ ./ r f Phillips AMENDED RESOLUTION Result / A RESOLUTION DETERMINING THE RATE OF TAX LEVY AND LEVYING TAXES UPON ALL REAL AND PERSONAL PROPERTY WITHIN SALT LAKE CITY, UTAH, MADE TAX- ABLE BY LAW, FOR THE YEAR 1978. WHEREAS, Sections 10-10-57 and 59-9-7 Utah Code Annotated require that, at a regularly scheduled meeting of the Board of Salt Lake City Commissioners, the said Board adopt and set the property tax mill levy on or before the second Monday of August of each year; and WHEREAS, all of the real property in Salt Lake County has been reevaluated, pursuant to a mandate of the Utah Legislature; and WHEREAS, the aforesaid reappraisal and evaluation of said property in Salt Lake County has now been largely completed and there has been a request by the Salt Lake County Auditor that the Utah State Tax Commission, by executive order, extend the date setting said mill levies to on or about September 13, 1978; and WHEREAS, there is some ambiguity as to the legal authority of the Utah State Tax Commission to delay the setting of the City's mill levy as set forth in the statutes of the State of Utah; and WHEREAS, it is the intent and desire of Salt Lake City to comply to the extent feasible with the mandate of the Utah Legislature, but reserve in itself the power to amend the mill levy set herein to guarantee, after final appraisal figures have been determined, that the City does not exceed the amount required for its governmental operations and the taxing authority granted by the Legislature of the State of Utah; and WHEREAS, the City Commission heretofore set its mill levy and it now has more accurate information for a mill levy setting; NOW, THEREFORE, BE IT RESOLVED by the Board of Salt Lake City Commissioners as follows: 1. For the purpose of defraying the necessary and proper expenses -2- of Salt Lake City, for maintaining the government thereof and for operating and maintaining its libraries and reading rooms, it is hereby determined that the rate of the general Salt Lake City property tax upon all real and personal property within Salt Lake City made taxable by law for the year 1978, be and the same hereby is determined to be 17.75 mills on each dollar assessed valuation of said property. The Board of Salt Lake City Commissioners hereby resolves that there be and there is hereby levied upon all real and personal property within Salt Lake City made taxable by law in the year 1978, for the fiscal year of Salt Lake City ending June 30, 1979, a tax of 17.75 mills on each dollar assessed valuation of said property for Salt Lake City as follows: (a) 15.00 mills for general fund and for general city pur- poses; (b) .5 mills for purposes of the Utah Governmental Immunity Act; (c) 2.25 mills for the purpose of defraying the necessary and proper expenses of Salt Lake City in maintaining and operating its libraries and reading rooms. 2. That the rate and levy hereinabove determined and levied be certified to the auditor of Salt Lake County, State of Utah and the Utah State Tax Commission. 3. The foregoing notwithstanding Salt Lake City, by and through the Board of Salt Lake City Commissioners, hereby expressly reserve the power and right to amend the foregoing resolution and to amend any property tax levy made herein as it may deem just, proper and appropriate under law, if more exact property reevaluation figures become known and the 1978 Salt Lake County property reappraisal, includ- ing reductions by the Board of Equalization, has been completed. 4. This Amended Resolution supercedes any previous resolution setting the mill levy passed in August 1978. 5. In the opinion of the Board of Commissioners it is necessary to the peace, health and welfare of the inhabitants of Salt Lake City -3- that this resolution take effect upon its passage and an emergency is hereby declared to exist so that the said levy may be made and said tax collected as required by law. 6.
