Finch Moran Mr.Chairman - - - Result RESOLUTION • WHEREAS, under date of August 7, 1924, Salt Lake'City entered into an agreement with Ellis S. Musser, by the terms of which said Ellis S. Musser was given the privilege of occupying a portion of Harvard Avenue until such time as Salt Lake City might need the same for street purposes, said permission being revocable by Salt Lake City upon sixty dayst notice to said Ellis S. Musser and upon removal of the fence back to the pro- perty line at the cost of Salt Lake City; and l:HER ESS, Salt Lake City desires to use the property mentioned therein for street purposes and is ready and willing to remove the fence back to the property line at its own cost; and WHEREAS, a similar agreement was executed by Salt Lake City and one named. J. G. Vincent as party of the second Dart; and. ',HIR CS, said J. G. Vincent agreement has never been executed by said J. G. Vincent. NO'vi, THEREFORE, BE IT RESOLVED that the said agreement of August 7, 1924, by and between Salt Lake City and Ellis S. Musser, and the permission to use and occupy the premises therein described be and the same is hereby revoked and the City Recorder be instructed to notify said Ellis S. Musser that sixty days after such notice Salt Lake City will remove the fence from the street in Harvard Avenue back to the property line of the said Ellis S. i4usser at its own cost. BE IT FURTHER RESOLVED that the aforesaid J. GL Vincent agreement and action of Salt Lake City in executing the same be .and the same hereby is rescinded and cancelled.
