Barker Harmsen Harrison ,�✓ Phillips RESOLUTION Result BE IT RESOLVED by the Board of Commissioners of Salt Lake City, Utah, in a duly constituted meeting held the 17th day of January, 1973, that the cone act existing between the municipality and the Utah State Tax Commission be amended to reduce the maximum amount that the Tax Commission may retain for its services of collecting the proceeds of the Local Option Sales Tax Ord- inance, and for the purpose of directing the Tax Commission to remit three- fourths(3/4)of one per cent(1%)of the proceeds of the municipality's sales tax ordinance directly to the Utah League of Cities and Towns as its payment of dues. The contract shall be of the purport of the attached Amendment No. 1 to the Agreement for State Administration of Local Sales and Use Taxes, which was reviewed by the governing body during the course of the meeting, and copy of which has been filed with the Minutes of the meeting. BE IT FURTHER RESOLVED that the Mayor shall be and is here- by empowered to execute said Amendment No. 1 to said Agreement, and that the City Recorder is hereby empowered to attest said amendment. BE IT FURTHER RESOLVED that said Amendment be forwarded by the City Recorder to the Utah League of Cities and Towns for future trans- mittal to the Utah State Tax Commission. C REC AMENDMENT NO, l to AGREEMENT FOR STATE ADMINISTRATION OF LOCAL SALES AND USE TAXES This amendment to that certain agreement entitled "Agreement for State Administration of Local Sales and Use Taxes" in effect between the Utah State Tax Commission and the undersigned municipality is hereby entered into, effective July 1, 1973, for the purpose of amending the below-stated paragraphs of said Agreement to read: Paragraph 3 of Article U is amended to read: 3, Disposition of Funds. Money collected pursuant to the ordinance may be deposited in the State Treasury to the credit of a Spec'al Sales Ta-: Fund ard may be drawn from that fund for the purpose of maki_ig refunds, for the purpose of compensating and reimbursing the Commission, and for the purpose of re- mitting membership dues on behalf of the municipality to the U`ah League of Cities anJ Towns in the amount designated by it, pursuant to Article IV of the Agreement, and for the purpose of transmitting to the municipality the amount to which the municipality is entitled. Such transmittals to or on behalf of the municipality shall be quarterly. Article IV of the Agreement is amended to read: Article IV. Costs of Administration and Payment of Dues. The munici- pality agrees that the Commission may withdraw from the Special Sales Tax Fund for the purpose of administering this Agreement, an amount equal to one- half per cent (1/2%) of the tax imposed by the ordinance and collected by the Commission. This figure may be renegotiated in future agreements to reflect more accurately actual costs of collection, but in any event not to exceed Amendment No. 1 - - page 2. one-half per cent (1/2%) of the tax collected. The municipality furthor authsriaea and directs the Tax Commission to withdraw from the Spacial Ss1ee Tax Fund and pay directly to the League an amount equal to three-fourth• per cent (3/4%) of the tax imposed and collected pursuant to the ardinance to be paid as membership dues to the Utah League of Cities and Towns. This Amendment No. 1 to the "Agreement for State Administration of Local Sales and Use Taxes" shall become effective July 1, 1973.
