+HEREAS, the Kearns St. iinn's Orphanage is a charitable
institution owned and held in trust and controlled by the Roman
Catholic Bishop of the Diocese of Salt Lake, thelRev. Joseph S.
Glass, and said Orphanage is located in Salt Lake County on the
south side of 12th South Street and oppo ite 4th East Street, and
the authorities of said Orphanage are desirous of connecting the
buildings thereof with the Salt Lake City sewer on 4th East Street
at a point about 25 feet north of the north property line of 12th
South Street, inasmuch Es there is no lateral sewer in and along
12th South Street and no sewer is likely to be laid there until
and unless said street'nd the property abutting on it shall be
taken into and incorporated with Salt Lake City:
NOW THEREFORE, BE IT RESOLVED by the Board of Commission-
ers of Salt Lake City, Utah, that permission be granted to the
authorities of the ::earns St. Ann's Orphanage to connect the build-
ings thereof with the Salt Lake City sewer in 4th East Street as
hereinbefore set forth, upon the condition that said authorities will
construct at their oven cost and expense a first class 6-inch sewer
across 12th South Street to connect with the sewer on 4th East Street,
and will take out and pay for the neces_ary permits for such :pork in
the City Engineer's office of Salt Lake City as re,uired by the
ordinances of said city; and that in case l::th South Street and the
property abutting thereon to the south and including the property
occupied by the said Kearns at. jinn's Orphanage shall hereafter be-
come a part of and be incorporated into the limits of Salt Lake City,
the authorities of said Orphanage will thereupon disconnect from the
sewer line on 1th East Street and connect with snob lateral. sewer as
may be laid along 12th South Street by ualt Lake City, and will
pay the sewer assessment which may thereupon be legally levied upon
the property occupied by said Orphanage abutting on said 12th South
Street.
BE IT FURTHER RESOLVED that a copy of this resolution be
furnished ther=tev. Joseph T. Glass aforesaid, and that the execution
of the work of connecting the buildings of said Orphanage with the
City's sewer on 4th east Street shall be deemed to be an acceptance
by the authorities of said Orphanage of the conditions hereinbefore
set forth.
