Result • Salt Lake City, U ah October 13 , 1953 The Board of City Commissioners of Salt Lake City, Salt Lake County, State of Utah, met in regular session at its regular meeting place at the City and County Building at 10:00 A.M. on October 13 th , 1953. The meeting was called to order by Mayor Earl J. Glade. On roll cell, the following members, constituting a quorum, were found to be present: Chairman Earl J. Glade Grant N. Burbidge Joe L. Christensen L. C. Romney B_ E_ Lingen alter Absent: igmrr After the meeting had been duly called to order and the roll called with the above result, the Mayor stated that one of the purposes of the meet- ing was to consider the approval of a contract dated May 26, 1953, between the Metropolitan Water District of Salt Lake City and The Salt Lake County Water Conservancy District. The following resolution was thereupon intro- duced in writing and upon motion duly made and seconded was unanimously adopted: WHEREAS, Salt Lake City has by virtue of its contract with the Metropolitan Water District of Salt Lake City, dated July 6, 1951, been granted various rights in a pipeline along 39th South Street from the Deer Creek Aqueduct to 9th East Street in Salt Lake County, Utah, and WHEREAS, the Metropolitan Water District of Salt Lake City has on or about the 26th day of May, 1953, entered into a contract with The Salt Lake County Water Conservancy District for the delivery of water from said 39th South Street pipeline at 9th East Street, which among other things, provides: "1. That subject to the following limitations, Metropolitan District will make available to and will turn out for the use of the Conservancy District from the said 39th South pipe line at its terminus and at such points on the said aqueduct as the Conservancy District may designate, such water, not to exceed a total of 3,000 acre feet during any one calendar - 2 - year, not more than 1,200 acre feet of which shall be delivered from the 39th South pipe line at rates not to exceed 5 cubic feet per second therefrom, nor more than a total of 20 cubic feet per second from the said Aqueduct, as the Conservancy District may from time to time order in writing. Such water will be delivered only and to the extent it is available to the disposition of Metropolitan District under the said Government- Association Contract and the said Subscription Contracts, and subject to and so far as consistent with other existing; obliga- tions and contracts of Metropolitan District, and while the Metropolitan District enpects to deliver water to the Conserva. cy District as aforesaid and will make reasonable effort so to do, the Metropolitan District does not guarantee against the effect of failures or breaks in the aqueduct or pipe line or necessary or expedient repairs or additions, water shortages, accidents, nor against any causes beyond its control which may make it impracticable to deliver water in the quantities, at the rates, or the places specified herein. And, WHEREAS, The Salt Lake County Water Conservancy District has, because of the interest of Salt Lake City in said 39th South pipe- line, requested the City to approve said contract, NOW, THEREFORE, BE IT RESOLVED that Salt Lake City approves and agrees to the provisions of the contract of May 26, 1953, between the Metropolitan Water District of Salt Lake City and The Salt Lake County Water Conservancy District, insofar as the provisions of said contract affect the interest of Salt Lake City in said line, and that Salt Lake City agrees that in its operation of the line it will not so orerate the line as to prevent Metropolitan Water District from carrying out the provisions of its said contract with the Salt Lake County Water Conservancy District, and in the event Salt Lake City exercises its rights to purchase the said line, it will, nevertheless, continue to permit deliveries of water to be made through the line in the manner provided in the said contract between the Metropolitan Water District and The Salt Lake County Water Conservancy District.
