A RESOLUTION OF THE CITY COMMISSION OF
SALT LAKE CITY CORPORATION, UTAH, OBLIGATING
SALT LAKE CITY CORPORATION TO EXPEND THE
SUM OF $35,100 TO BE REALIZED FROM THE SALE
OF 2.3 ACRES OF LAND ACQUIRED WITH FEDERAL
AID AND LOCATED WITHIN THE BOUNDARIES OF THE
SALT LAKE CITY INTERNATIONAL AIRPORT.
WHEREAS, the Federal Aviation Administration has advised
the Salt Lake City Corporation, Utah, that the administrator
of the Federal Aviation Administration has adopted a policy
requirement that as a condition to release any Salt Lake City
International Airport property interest therein for subsequent
sale from the terms and conditions in Grant FAAP Agreements
No. 9-42-018-801 through 9-42-018-C723 and ADAP Grant Agreements
8-49-0033-1 through 6-49-003-11 covering federal aid at said
Salt Lake City International Airport, the Salt Lake City Corpora-
tion, Utah, shall agree to expend the sum of $35,100 to be
received from the sale of the hereinafter described land within
a period of five years from the date of this resolution; and
WHEREAS, the City Commission of the Salt Lake City Corporation,
Utah, has approved the sale of the hereinafter described land
located at the Salt Lake City International Airport subject to
its release for that purpose by the Federal Aviation Administra-
tion, and recognizes the need for the continued provisions of
adequate public airport facilities to be provided the residents
of Salt Lake City, Utah.
NOW, THEREFORE, BE IT RESOLVED, by the Board of City
Commissioners of Salt Lake City Corporation, Utah, that in con-
sideration of the Federal Aviation Administration's approval and
release for sale of the hereinafter described land and upon
said sale the City Commission of Salt Lake City Corporation,
Utah, does hereby promise and covenant and agree with the Federal
Aviation Administration as follows:

1. A special airport improvement trust fund is hereby
established. Salt Lake City Corporation will deposit in said fund
the sum of $35,100 being the total net proceeds from the sale
and transfer of 2.34 acres of land located at the Salt Lake
City International Airport to the Utah Department of Transporta-
tion.
2. Within five years from the date of this resolution,
unless substitutions and changes in priority are made which are
mutually agreeable to the Federal Aviation Administration and
the City, the funds deposited into said trust fund hereby
established shall be expended on projects listed below for the
further development of the Salt Lake City International Airport
in order of their priority:
(a) Approval items on airport development set forth in
FAR Part 152 (and as appropriate, in the NASP by priority of
need) to be accomplished in accordance with currently applicable
FAA design criteria.
(b) Any aeronautical items of airport development ineligible
under the ADAP.
(c) Deposit to an identifiable account in a public fund
for deferred use within a reasonable time for items in priority
(a) and (b) above.
(d) Retirement of airport bonds which are secured by pledges
of airport revenue, including repayment of loans from other
Federal agencies for such development.
(e) Development of common use facilities and utilities of
dedicated revenue production property of the airport.
3. Projects for the further development of the Salt Lake
City International Projects for the further development of the
Salt Lake City International Airport outlined in Section 2, or any
approved substitutions, shall be performed by the City without
federal matching funds from a federal aid program for airports
to the limit of said funds. Projects determined by the City and
the FAA to be priority number one shall be accomplished before

expenditure of Trust Funds on items of lower priority.
4. The Fund hereby established and this Resolution shall
remain in effect until the funds are expended in accordance with
the provisions of Section 2 in order to comply with the condi-
tions set forth in the Deed of Release from the FAA requiring the
establishment of this Fund.
5. The Instrument of Release dated
from the Federal Aviation Administration relating to land at the
Salt Lake City International Airport, a copy of which is attached
hereto and incorporated herein, is hereby accepted and the
President of the City Council is hereby authorized and directed
to accept said Instrument of Release for and on behalf of Salt
Lake City Corporation and the City Clerk is directed to attest
same and to affix the Seal of the City thereto.
6. The land approved for sale subject to release by the
Federal Aviation Administration is described as follows:
A parcel of land in fee for a freeway known as
Project 80-3, being part of an entire tract of
property, in the SE1/4 SE1/4 of Section 31 and in the
SW1/4 SW1/4 of Section 32, T.1 N., R.1 W., S.L.B.& M.
The boundaries of said parcel of land are described as
follows:
Beginning in the center line of the Office Revision of
the northbound lanes of 40th West of said project at
Engineer Station 1218+36.02, which point is approxi-
mately 1062.49 ft. north and 242.64 ft. each from the
SW corner of said Section 32; thence S. 78°36'42" E.
48 ft.; thence S. 02°17'33" W. 258.91 ft. to the
northerly right of way line of the existing highway
known as Project No. FI-120(13) ; thence S. 89°58' W.
391.69 ft. along said northerly right of way •line;
thence N. 9°00'44" E. 278.84 ft.; thence S. 89°35'56"
E. 52 ft. to the center line of the Office Revision
of the southbound lanes of said 40th West at Engineer
Station 1218+47.19; thence S. 88°32'11" E. 259.39 ft.
to the point of beginning as shown on the official
map of said project on file in the office of the Utah
Department of Transportation. The above described
parcel of land contains 2.34 acre, more or less.
To enable the Grantee to construct and maintain a
public highway as a freeway, as contemplated by Title
27, Chapter 12, Section 96, Utah Code Annotated,
1953, as amended, the Grantor hereby releases and
relinquishes to the Grantee any and all rights or
easements appurtenant to the Grantor's remaining
property by reason of the location thereof with
reference to said freeway, including, without limiting
the foregoing, all rights of ingress to or egress from

the Grantor's remaining property contiguous to the
land hereby conveyed, to or from said freeway, over
and across the westerly and easterly right of way
and no-access lines of said freeway as shown on the
official map of said project on file in the office
of said Grantee.
7. Be it further resolved, by the Board of Commissioners
of Salt Lake City Corporation, Utah, that the Mayor of Salt
Lake City Corporation is hereby authorized and directed to
accept an instrument of release from the Federal Aviation
Administration for the purpose of binding the Salt Lake City
Corporation, Utah, to all its promises, covenants and agreements
set forth in this resolution.
I hereby certify that the foregoing resolution was intro-
duced and read at a regular meeting of the Board of City
Commissioners of Salt Lake City Corporation, Utah, on the
6th day of November , 1979, and was duly adopted
at said meeting.
