pancy in order that construction
may commence in the near future.

WHEREAS, Salt Lake City acting in conjunction with the State
Road Commission of the State of Utah has determined that it is necessary
to widen the traveled portion of Second West Street between Ninth South
Street and Victory Road; and
WHEREAS, such widening is required by the public, interest and •
necessity in connection with the movement of traffic upon said street;
and
WHEREAS, certain encroachments exist within the platted right
of way of Second West Street between Second and Third South Streets;
and
WHEREAS, the public interest and necessity require the
immediate removal of such encroachments and the immediate occupancy of
the full width of Second West Street within the limits of the widening
project for street and highway purposes; and
WHEREAS, certain owners of said encroachments claim a pur-
ported interest in the land covered by said encroachments contrary to
that of the public therein; and
WHEREAS, the public interest and necessity require the
immediate acquisition of any interest in said land which is repugnant
to the right of Salt Lake City to occupy and use the real property
hereinafter described for street and highway purposes;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS
OF SALT LAKE CITY, UTAH:
1. That it is necessary and in the public interest of Salt
Lake City and its inhabitants that the traveled portion of Second West
Street between Ninth South and Victory Road be widened and that the
encroachments upon the right of way within the limits of Second West
Street be removed in order that the entire width of Second West Street
may be available to Salt Lake City for the location and construction

of street and highway across said land.
2. That whatever permission, expressed by grant or implied
by acquiescence, that may have heretofore existed allowing any abutting
property owner to encroach upon said right of way, be, and the same
hereby is, revoked.
3. That condemnation proceedings, including therein the
right of immediate occupancy, be, and the same hereby are, authorized
to be brought in the name of Salt Lake City by the Law Department
thereof to acquire all outstanding interests adverse to that of the
public, if any, in the land hereinafter described for the necessary
widening of Second West Street as hereinabove set forth.
4. The parcel of land hereinabove referred to and hereby
authorized to be cleared of all outstanding interests, if any, adverse
to that of the public, by condemnation proceedings, is situated in the
County of Salt Lake, State of Utah, and is more particularly described
as follows:
Beginning at the Northeast corner of Block 61,
Plat "A" Salt Lake City Survey and running thence
East 132 feet crossing 2nd West Street to the North-
west corner of Block 60 of said Plat "A", thence
South 660 feet to 3rd South Street; thence West 132
feet to the West side of 2nd West Street; thence
North 660 feet to 2nd South Street and the point of
beginning; the above described property is known as
2nd West Street in Salt Lake City, Utah, between 2nd
and 3rd South Streets and is within Section 1, Town-
ship 1 South, Range 1 West of the Salt Lake Base and
Meridian.
Passed by the Board of Commissioners of Salt Lake City, Utah,
this 4th day of June 1962.
