WHEREAS, Salt Lake City is constructing public comfort
stations for men and women at the northeast corner. of State and •
Third South Streets in' said city upon which corner is located the
Auerbach store building owned by Samuel H. Auerbach, and that in
the construction of the lien's public comfort station, said city
has constructed a wall inside the property line of said Auerbach's--
said wall being a continuation of one constructed outside said
property line in Third South Street, and
WHEREAS, Said Samuel H. Auerbach has consented to the con-
• struction and maintenance of said wall upon his said premises
until such time" as he or his heirs or assigns shall desire to
use the ground upon which said wall now stands, and
AREAS, Said Samuel H. Auerbach has requested of Salt Lake
City a disclaimer of any right, title or interest in the ground
upon which said wall is constructed upon his said property and an
agreement to remove said wall when so requested by him or his heirs
or assigns.
NOW THEREFORE, Be It Resolved by the Board of Commissioners ,
of Salt Lake City, that Salt Lake City hereby disclaims any right,
title or interest in the ground upon which the wall above mentioned
is. situated within the property line of said Samuel H. Auerbach,
and hereby agrees that upon notice from said Samuel H. Auerbach,
his heirs or assigns it will remove said wall from said premises.
