Result
WHEREAS, the track franchise of the Denver and Rio Grande Western Railroac
Company which commences at the intersection of 9th South Street and 200 West
Street, and runs along 200 West street to approximately 50 North, thence West
to 400 West, thence North along 400 West to the end of the street at approxi-
mately 900 North, expired on December 31, 1974; and
WHEREAS, no new franchise for said railroad was agreed upon; and
WHEREAS, substitute service for those customers of the railroad remaining
on the line can be arranged for through substitute service; and
WHEREAS, it is in the best interest of the residents of Salt Lake City fo]
the development of the area in which said franchise was located that said track:
be removed from said streets and that the involved streets be repaved.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Salt Lake
City, Utah, that pursuant to said franchise and section 35-2-8, Revised Ordin-
ances of Salt Lake City, and section 10-8-82, Utah Code Annotated, the Denver
and Rio Grande Western Railroad Company is hereby notified and required to
remove its industrial tracks which were installed under said expired franchise
and which tracks commenced at the intersection of 9th South Street and 200 West
Street, thence run along 200 West STreet to approximately 50 North, thence West
to 400 West, thence North along 400 West to the end of the street at approxi-
mately 900 North.
BE IT FURTHER RESOLVED that the Denver and Rio Grande Western Railroad
Company commence removal of said trackage within 90 days from March 16, 1976,
and that said trackage be entirely removed within a reasonable time, not to
exceed 180 days from said date.
BE IT FURTHER RESOLVED that, pursuant to the requirement of said franchi'
the Denver and Rio Grande Western Railroad Company shall, after removal of sal,
trackage and attendant facilities, restore said street to a condition uniform
with the balance of said street with respect to grade, materials and construc-
tion, and to the satisfaction of the City Street Department and Traffic Engine
The City Recorder is hereby directed to deliver a copy of the Resolutior
to Mr. Robert Merrill, Attorney for Denver and Rio Grande Western Railroad Con
pany at 141 East 1st South Street, Salt Lake City, Utah, 84111, and to the
Public Service Commission of the State of Utah at 330 East 450 South, Salt La]
City, Utah.
Passed by the Board of Commissioners of Salt Lake City, Utah, this 24th
day of March, 1976.
