028 of 2012 - Rezone property at 206 North 200 West; Capitol Hill Community Master Plan 0 12-1 P 12-9 SALT LAKE CITY ORDINANCE No. 28 of 2012 (Amending the future land use map of the Capitol Hill Community Master Plan and amending the zoning map pertaining to property located at 206 N. 200 West from Moderate Density Multi-Family Residential (RMF-35) to Neighborhood Commercial (CN)) An ordinance amending the future land use map of the Capitol hill Community Master Plan to change the land use classification of property located at 206 N. 200 West from medium density residential to Neighborhood Commercial, and amending the zoning map to re-zone property located at 206 N. 200 West from Moderate Density Multi-Family Residential (RMF-35) to Neighborhood Commercial (CN) pursuant to Petition Nos. PLNPCM2011-00176 and PLNPCM2011-00385. WHEREAS, the Salt Lake City Planning Commission ("Planning Commission") held a public hearing on August 10, 2011 on an application submitted by Mayor Ralph Becker ("Applicant") to amend the future land use map of the Capitol Hill Community Master Plan to change the land use classification of property located at 206 N. 200 West (the "Property") from medium density residential to Neighborhood Commercial, and amending the zoning map to re- zone the Property from Moderate Density Multi-Family Residential (RMF-35) to Neighborhood Commercial (CN) pursuant to Petition Nos. PLNPCM2011-00176 and PLNPCM2011-00385; and WHEREAS, at its August 10, 2011 meeting, the Planning Commission voted in favor of forwarding a positive recommendation to the Salt Lake City Council ("City Council") on said applications; and WHEREAS, after a public hearing on this matter the City Council has determined that adopting this ordinance is in the City's best interests. NOW, TIIEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. Amending the Capitol Hill Community Master Plan. The Future Land Use Map of the Capitol Hill Community Master Plan shall be and hereby is amended to change the designated future land use for the Property located at 206 N. 200 West (Tax ID No. 08-36- 404-012), and which is more particularly described in Exhibit"A" attached hereto, from medium density residential to Neighborhood Commercial. SECTION 2. Amending the Zoning Map. The Salt Lake City zoning map, as adopted by the Salt Lake City Code, relating to the fixing of boundaries and zoning districts, shall be and hereby is amended to reflect that the Property described in Section 1 above, shall be and hereby is re-zoned from Moderate Density Multi-Family Residential (RMF-35) to Neighborhood Commercial (CN). SECTION 3. Effective Date. This ordinance shall become effective on the date of its first publication. Passed by the City Council of Salt Lake City, Utah, this 15th day of May , 2012.
