006 of 1998 - Landfill Budget AmendmentSALT LAKE CITY ORDINANCE No. 6 of 1998 (Amending the Landfill Budget which was prepared and submitted by the Solid Waste Management Council, for calendar year 1998 subject to specific policy directives.) AN ORDINANCE AMENDING SALT LAKE CITY ORDINANCE NO. 86 OF 1997 WHICH ADOPTED THE LANDFILL BUDGET, AS PREPARED AND SUBMITTED BY THE SOLID WASTE MANAGEMENT COUNCIL, FOR CALENDAR YEAR 1998, SUBJECT TO SPECIFIC POLICY DIRECTIVES. PREAMBLE The City and Salt Lake County (the "County") entered into an interlocal cooperation agreement regarding the joint management and operation of the landfill. The agreement established the Solid Waste Management Council and provided it with authority and responsibility relating to the operation and management of the landfill. Pursuant to the agreement, all actions by the Solid Waste Management Council constitute recommendations to the City and the County and that the City and the County have the power to review, ratify, modify or veto any action of the Solid Waste Management Council. On December 9, 1997, the City Council adopted the Landfill Budget, as prepared and submitted by the Solid Waste Management Council, for calendar year 1998, subject to specific policy directive. The County also approved the budget as prepared and submitted by the Solid Waste Management Council. Proposed amendments to said duly adopted Landfill Budget prepared and submitted by the Solid Waste Management Council, copies of which are attached hereto, have been prepared and filed with the City Recorder for consideration by the City Council and inspection by the public. The City Council fixed the time and place for a public hearing to be held on January 20, 1998 to consider adoption of the attached amendments and ordered notice thereof be published at least seven days prior to the hearing. Notice of said public hearing, to consider adoption of said amendments, was duly published as required herein. A public hearing to consider adoption of the attached amendments was held on January 20, 1998 in accordance with said notice, at which hearing all interested persons were heard for and against the attached amendments. The amendments to said budget have been duly considered by the City Council. All conditions precedent the City must satisfy to amend said Landfill budget have been accomplished. Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. PURPOSE. The purpose of this ordinance is to amend the Landfill Budget, which was prepared and submitted by the Solid Waste Management Council, for calendar year 1998, subject to specific policy directives, as approved and ratified by Salt Lake City Ordinance No. 86 of 1997. SECTION 2. ADOPTION OF AMENDMENTS. Subject to similar approval by the County, the budget amendments, attached hereto and made 2 a part of this ordinance be, and the same hereby, are adopted and incorporated into the Landfill Budget for calendar year 1998. SECTION 3. PUBLIC INSPECTION. Copies of the attached amendments to the Landfill Budget shall be available for public inspection during regular business hours in the Office of the City Recorder. SECTION 4. RESERVE THE RIGHT TO AMEND. The City reserves the right to amend the Landfill Budget, including the attached budget amendments, at any time. SECTION 5. EFFECTIVE DATE. Ordina98\Amending landfill budget.doc MAYOR 4 TO: City Council FROM: Steve Fawcett DATE: December 22, 1997 RE: Salt Lake Valley Solid Waste Facility (Landfill) January 1998 Amendment The Salt Lake Valley Solid Waste Facility January budget amendment is attached for your review. The calendar year 1997 budget for the Salt Lake Valley Solid Waste Facility (Landfill) included $6,000,000 for the construction of the transfer station. The budget year will end December 31, 1997. Due to delays in acquiring the land for the transfer station site, negotiating with the railroad, and fine tuning the RFP design and specifications, the transfer station construction costs of $6,000,000 have been delayed until calendar year 1998. The land was officially purchased in November of 1997 and the RFP should be out shortly. This request is for the City Council to approve the appropriation of the $6,000,000 budget for the transfer station construction in calendar year 1998. The County Auditor will appropriate the funds to be spent in calendar year 1998.
