(Amending Section 6.08.081, Salt Lake
City Code, allowing brew pubs limited
rights to distribute beer in kegs
pursuant to Petition No. 400-94-40)
AN ORDINANCE AMENDING SECTION 6.08.081, SALT LAKE CITY CODE,
ALLOWING BREW PUBS LIMITED RIGHTS TO DISTRIBUTE BEER IN KEGS
PURSUANT TO PETITION NO. 400-94-40.
WHEREAS, the City Council has considered amending certain
provisions of the Class F brew pub and microbrewery beer licenses
to allow brew pubs to make certain limited distribution of beer
in kegs and believes the following amendments to be in the best
interests of the City;
NOW, THEREFORE, be it ordained by the City Council of Salt
Lake City, Utah:
SECTION 1. That Section 6.08.081, Salt Lake City Code, be,
and the same hereby is, amended to read as follows:
6.08.081 Class F licenses --Brew pubs and microbreweries--
Definitions.
The following definitions are applicable to the provisions
of Section 6.08.081 through 6.08.089.
A.

B. "Brew pubs" means:
1. restaurant -type establishments that also have a
beer brewery, producing beer in batch sizes not less than
seven U.S. barrels (thirty-one (31) gallons), on the same
property which produces, except as provided in subsection 2,
only enough beer for sale and consumption on site or for
retail carry -out sale in containers holding less than two
liters. At least fifty percent (50%) of the beer sold shall
be brewed on the premises. Revenue from food sales shall
constitute at least fifty percent (50%) of the total
business revenues, excluding retail carry -out sales of beer
and the sales allowed pursuant to subsection 2.
2. Brew pubs may sell beer in keg (15.5 gallon)
containers for the following purposes and in the following
amounts:
a. An unlimited number of kegs for "brew fests"
which, for the purpose of this section, means events,
the primary purpose of which is the exposition of beers
brewed by brew pubs and microbreweries which includes
the participation of at least three (3) such brewers.
b. No more than one hundred (100) kegs per year
to events sponsored by charitable organizations exempt
from federal income tax pursuant to 26 U.S.C., Section
501(c)(3); and
c. No more than one hundred (100) kegs per year
to events operating under a single event license from
the state and the City where the purpose of the event
is not for commercial profit and where the beer is not
wholesaled to the event sponsor but is, instead,
dispensed by employees of the brew pub.
3. The numerical limits and other provisions of
subsection 2 shall be reviewed by the City Council between
September and December of 1996. If no amendment is made to

subsection 2 prior to January 1, 1997, subsection 2 shall
continue in effect.

SECTION 2. This ordinance shall become effective
immediately upon its first publication.
