RESOLUTION NO. 139 OF 1987
AUTHORIZING THE EXECUTION OF AN
INTERLOCAL AGREEMENT BETWEEN
SALT LAKE CITY AND DIRECTORS AND
OFFICERS OF THE HOUSING DEVELOPMENT
CORPORATION FOR INDEMNIFICATION
WHEREAS, Title 11, Chapter 13, U.C.A., 1953, as amended,
allows public entities to enter into cooperative agreements to
provide joint undertakings and services; and
WHEREAS, the Housing Authority is a body corporate and
politic, created pursuant to Section 55-18-1, et seq., U.C.A.;
and
WHEREAS, the Authority has created the Housing Development
Corporation, a Utah nonprofit corporation to aid in creation of
housing for low income and elderly residents of the city; and
WHEREAS, the City desires to assist the Authority pursuant
to Section 55-18-26(8) and (10) and Section 55-18-28, U.C.A., and
any other applicable statutes or common law in the mission of the
Authority, and the corporation, to provide the City with low
income and elderly housing; and
WHEREAS, the attached Indemnity Agreement Form has been
prepared to accomplish these purposes;
THEREFORE, BE IT RESOLVED by the City Council of Salt Lake
City, Utah:
1. The Council does hereby approve the attached agreement
which is generally described as follows:
An agreement between the City and potential directors
and officers of the Housing Development Corporation
for indemnification from damages.
2. Palmer A. DePaulis, Mayor of Salt Lake City, Utah, is
hereby authorized to execute said agreements on behalf of Salt
Lake City Corporation and to act in accordance with their terms.
