HomeMy WebLinkAbout018 of 2025 - Text Amendment - Permitting Outdoor Theaters in Commercial Districts1 SALT LAKE CITY ORDINANCE No. _____ of 2025 Amending Title 21A of the Salt Lake City Code to permit outdoor theaters in commercial districts) An ordinance amending the text of Title 21A of the Salt Lake City Code pertaining to permitting outdoor theaters in commercial districts, pursuant to Petition No. PLMPCM2024- 00595. WHEREAS, on October 9, 2024, the Salt Lake City Planning Commission (“Planning Commission”) held a public hearing on a petition initiated by the Salt Lake City Council (“City Council”) to amend Salt Lake City’s land use regulations to permit live performance theaters, either indoor or outdoor, within the CG General Commercial district (Petition No. PLMPCM2024-00595); and WHEREAS, at its October 9, 2024 meeting, the Planning Commission voted in favor of forwarding a positive recommendation to the City Council on said petition; and WHEREAS, after a public hearing on this matter the City Council has determined that adopting this ordinance is in the city’s best interests. NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. Amending the text of Section 21A.33.020. Amending the text of Section 21A.33.020. That Section 21A.33.020 (Zoning: Land Use Tables: Table of Permitted and Conditional Uses for Residential Districts) is amended as to “Qualifying provisions” number 13, with no other revisions to the section, as follows: 13. Prohibited on lots located within 1,000 feet of a Single- or Two-Family Zoning District. SECTION 3. Amending the text of Section 21A.33.030. That Section 21A.33.030 (Zoning: Land Use Tables: Table of Permitted and Conditional Uses for Commercial Districts) is amended to revise the existing use category “Theater, live performance” and create a new use category “Theater, live performance (Outdoor)” immediately thereafter in the list of uses, with no other revisions to the table, as follows: Use Permitted And Conditional Use By District CN CB CS1 CC CSHBD1 CG SNB Theater, live performance Indoor) P12 P12 P12 P12 P12 Theater, live performance Outdoor) P25 SECTION 4. Amending the text of Section 21A.33.030. That Section 21A.33.030 (Zoning: Land Use Tables: Table of Permitted and Conditional Uses for Commercial Districts) is amended as to “Qualifying provisions” number 13 and a new number 25 (to be inserted in numerical order with the other qualifying provisions), with no other revisions to the section, as follows: 12. Prohibited on lots located within 1,000 feet of a Single- or Two-Family Zoning District. 25. Prohibited on lots located within 1,000 feet of Residential Districts (21A.24). 4 SECTION 5. Amending the text of Section 21A.33.035. Amending the text of Section 21A.33.050. That Section 21A.33.050 Zoning: Land Use Tables: Table of Permitted and Conditional Uses for Downtown Districts) is amended as to “Qualifying provisions” number 9 and a new number 21 (to be inserted in numerical order with the other qualifying provisions), with no other revisions to the section, as follows: 9. Prohibited on lots located within 1,000 feet of a Single- or Two-Family Zoning District. 21. Prohibited on lots located within 1,000 feet of Residential Districts (21A.24 of this title). 6 SECTION 9. Amending the text of Section 21A.62.040. That Section 21A.62.040 Zoning: Definitions: Definitions of Terms) is amended only as to the definition of “Theater, Live Performance” as follows: THEATER, LIVE PERFORMANCE: An indoor or outdoor venue whose principal use is any combination of music, theater, or dance performed by one or more persons. SECTION 15. Effective Date. This ordinance shall become effective on the date of its first publication. Passed by the City Council of Salt Lake City, Utah, this ______ day of ______________, 2025.
